【摘要】:專屬經濟區(qū)(Exclusive Economic Zone,以下簡稱EEZ)制度是《聯(lián)合國海洋法公約》(以下簡稱公約))的一大創(chuàng)舉,但《公約》是海洋大國與廣大發(fā)展中沿海國相互妥協(xié)的產物,因此存在眾多模糊之處,沿海國對其EEZ的外國平時海上軍事活動的規(guī)制問題就是其中之一。所以,對這類問題的研究是有深遠的理論意義和積極的現實意義的。 本文除前言和結語外,共分為五個部分: 一、概括論述平時軍事活動的概念、分類。本文將研究對象界定在非沿海國的軍艦在沿海國的EEZ的平時軍事活動,主要探析沿海國對該區(qū)域的外國軍事活動的規(guī)制問題。 二、評析美國在我國EEZ進行軍事活動的法律依據,包括EEZ是國際水域、進行軍事活動是航行自由和其他國際合法用途、測量活動不是海洋科研以及美國不是《公約》締約國。 三、篩選出《公約》中的相關規(guī)定,并結合由第21專家組起草的《專屬經濟區(qū)航行和飛越指南》(以下簡稱指南))對這些規(guī)定進行評析,包括“和平利用海洋”、“禁止武力或以武力威脅”、“適當顧及”、“權利濫用”和“剩余權利規(guī)則’原則。 四、列舉一些發(fā)達國家和發(fā)展中國家的相關實踐,包括澳大利亞的海事識別制度,日本、越南、印尼以及其他國家的相關法律規(guī)定,以尋找沿海國規(guī)制其EEZ的軍事活動的現實依據。 五、對我國規(guī)制EEZ內的外國平時軍事活動提出建議。包括對我國完善國內立法和參與國際海洋事務的建議,以及為了及時應對EEZ的軍事活動的一些措施建議。 本文的創(chuàng)新之處在于,以《公約》為主線,在廣泛參閱《聯(lián)合國憲章》和《指南》的基礎上,結合一系列國際法基本原則,充分駁斥了美國在我國EEZ進行軍事活動的法律依據,系統(tǒng)地闡釋了沿海國規(guī)制在其EEZ的外國軍事活動的國際法根據,并對規(guī)制在我國EEZ內的外國軍事活動提出了諸多建議。
[Abstract]:Exclusive Economic one (hereafter referred to as EEZ) system is one of the innovations of the United Nations Convention on the Law of the Sea (hereinafter referred to as the Convention), but the Convention is the product of mutual compromise between the major maritime powers and the vast number of developing coastal States, so there are many ambiguities. One of them is the regulation of foreign maritime military activities of EEZ by coastal states. Therefore, the study of this kind of problems is of profound theoretical significance and positive practical significance. In addition to the preface and conclusion, this paper is divided into five parts:. Firstly, the concept and classification of peacetime military activities are summarized. The object of study is defined as the peacetime military activities of warships in the coastal states in the EEZ of the coastal states, and the regulation of the foreign military activities in the region by the coastal states is mainly discussed in this paper. The second is to analyze the legal basis of American military activities in EEZ in China, including that EEZ is international waters, that military activities are freedom of navigation and other international legal purposes, that surveying activities are not marine scientific research and that the United States is not a signatory to the Convention. (III) to screen out the relevant provisions of the Convention and to assess them in the context of the Guide to Navigation and overflight in the exclusive Economic Zone (hereinafter referred to as the Guide), drafted by expert Group 21, These include "peaceful uses of the sea", "prohibition of force or threat of force", "due regard", "abuse of rights" and "residual rights rule". Fourth, enumerate the relevant practices of some developed and developing countries, including the maritime identification system of Australia, the relevant laws and regulations of Japan, Vietnam, Indonesia and other countries, In order to find the coastal state to regulate its EEZ military activities on the basis of reality. Fifthly, some suggestions are put forward to regulate foreign peacetime military activities in EEZ, including suggestions on perfecting domestic legislation and participating in international maritime affairs, as well as some measures to deal with the military activities of EEZ in time. The innovation of this paper is that, taking the Convention as the main line, and on the basis of extensive reference to the Charter of the United Nations and the Guide, and combining a series of fundamental principles of international law, This paper fully refutes the legal basis of American military activities in EEZ of our country, systematically explains the international law basis of the regulation of foreign military activities in China's EEZ by coastal states, and puts forward many suggestions for regulating foreign military activities in China's EEZ.
