【摘要】：WTO框架中的農(nóng)產(chǎn)品出口補(bǔ)貼是各國(guó)利益博弈的焦點(diǎn),但是一直沒有得到妥善解決�！堆a(bǔ)貼與反補(bǔ)貼守則》、《農(nóng)產(chǎn)品協(xié)定》對(duì)農(nóng)產(chǎn)品出口補(bǔ)貼問題有所規(guī)定但是也極為有限,發(fā)達(dá)國(guó)家依然通過(guò)各種措施對(duì)本國(guó)農(nóng)產(chǎn)品出口提供補(bǔ)貼。本文分析了WTO框架下的農(nóng)產(chǎn)品出口補(bǔ)貼法律問題,并且針對(duì)我國(guó)應(yīng)對(duì)農(nóng)產(chǎn)品出口補(bǔ)貼問題提出了一些建議,全文主要分為如下部分: 導(dǎo)言。導(dǎo)言部分交代了研究背景、主要研究?jī)?nèi)容、研究現(xiàn)狀以及相關(guān)重要概念的含義;第一章是農(nóng)產(chǎn)品出口補(bǔ)貼國(guó)際規(guī)則的演變。通過(guò)對(duì)農(nóng)產(chǎn)品出口補(bǔ)貼法律規(guī)則演變的研究,總結(jié)農(nóng)產(chǎn)品出口補(bǔ)貼規(guī)則的演變特點(diǎn)。第二章是農(nóng)產(chǎn)品出口補(bǔ)貼認(rèn)定的法律問題。本章主要對(duì)農(nóng)產(chǎn)品出口補(bǔ)貼的認(rèn)定問題展開研究,如數(shù)量認(rèn)定、認(rèn)定標(biāo)準(zhǔn)以及各國(guó)在農(nóng)產(chǎn)品出口補(bǔ)貼認(rèn)定上存在的差異;第三章是農(nóng)產(chǎn)品出口補(bǔ)貼的執(zhí)行規(guī)則問題。主要研究了農(nóng)產(chǎn)品出口補(bǔ)貼規(guī)則的執(zhí)行機(jī)制,如農(nóng)產(chǎn)品出口補(bǔ)貼的執(zhí)行、監(jiān)督以及權(quán)利救濟(jì);第四章是中國(guó)應(yīng)對(duì)農(nóng)產(chǎn)品出口補(bǔ)貼的立場(chǎng)與策略問題。本章探討了我國(guó)在入世文件中對(duì)農(nóng)產(chǎn)品出口補(bǔ)貼的承諾以及在多哈回合談判中的立場(chǎng),此外還分析了我國(guó)利用WTO爭(zhēng)端解決機(jī)制應(yīng)對(duì)農(nóng)產(chǎn)品出口補(bǔ)貼問題的策略。
[Abstract]:The export subsidy of agricultural products in the framework of WTO is the focus of the interest game of various countries, but it has not been properly resolved. The Agreement on Agricultural products provides for the export subsidy of agricultural products, but it is also very limited. Developed countries still provide subsidies to their agricultural exports through various measures. This paper analyzes the legal problems of agricultural export subsidies under the framework of WTO, and puts forward some suggestions on how to deal with the problem of agricultural export subsidies in China. The full text is divided into the following parts:. Introduction. The introduction describes the background of the research, the main research content, research status and the meaning of relevant important concepts; The first chapter is the evolution of the international rules on agricultural export subsidies. The second chapter is the legal issues of the recognition of agricultural export subsidies. This chapter mainly studies the identification of agricultural export subsidies, such as quantity determination, The third chapter is about the enforcement rules of agricultural product export subsidy. It mainly studies the enforcement mechanism of agricultural product export subsidy rules, such as the implementation of agricultural product export subsidy. Chapter 4th is China's position and strategy in dealing with agricultural export subsidies. This chapter discusses China's commitment to agricultural export subsidies in the WTO accession document and its position in the Doha Round of negotiations. In addition, the paper analyzes the strategies of using WTO dispute settlement mechanism to deal with the export subsidy of agricultural products.
