【摘要】：理論學(xué)界自共同但有區(qū)別責(zé)任原則出現(xiàn)以來(lái)無(wú)論是在內(nèi)容上還是在定義都沒(méi)有比較明確的界定,尤其是在其地位上的模糊不清造成了如今執(zhí)行力度不足的困境。本文將從定義、性質(zhì)、內(nèi)容、意義、面臨的問(wèn)題以及解決的途徑這幾個(gè)方面詳細(xì)系統(tǒng)地介紹該原則,以便我們對(duì)于該原則能夠有個(gè)清楚的認(rèn)識(shí)。 雖然共同但有區(qū)別責(zé)任原則的提出和適用對(duì)于遏制全球氣候變暖具有非常重要的影響力,但是該原則在國(guó)際法中的地位依然沒(méi)有得到明確的地位,所以該原則的成熟性不高。 從實(shí)踐性角度分析,共同但有區(qū)別責(zé)任原則在適用中存在的問(wèn)題。該原則在現(xiàn)實(shí)中不僅缺乏有效的保障措施而且面臨許多現(xiàn)實(shí)的挑戰(zhàn)。盡管在適用中存在許多問(wèn)題,然而該原則的重心一直強(qiáng)調(diào)的是區(qū)別責(zé)任。而區(qū)別責(zé)任的標(biāo)準(zhǔn)在制定時(shí)應(yīng)當(dāng)綜合考慮承擔(dān)責(zé)任的時(shí)間,主體,標(biāo)準(zhǔn),數(shù)量以及形式上的不同。 探討貫徹共同但有區(qū)別責(zé)任原則的具體對(duì)策是本文的重心。構(gòu)建發(fā)展中國(guó)家承擔(dān)責(zé)任的能力是在實(shí)踐中落實(shí)共同但有區(qū)別責(zé)任原則的重要措施。而發(fā)展環(huán)保產(chǎn)業(yè)既可以在保證發(fā)展中國(guó)家獲得經(jīng)濟(jì)利益的同時(shí)保護(hù)環(huán)境,所以本章以理想主義為基調(diào)重點(diǎn)強(qiáng)調(diào),發(fā)展環(huán)保產(chǎn)業(yè)是在發(fā)展中國(guó)家適用共同但有區(qū)別責(zé)任原則的新思路。
[Abstract]:Since the emergence of the principle of common but differentiated responsibilities in theoretical circles, there has been no clear definition either in content or in definition, especially the ambiguity in its status has led to the predicament of insufficient enforcement. In order to have a clear understanding of the principle, the nature, content, meaning, problems and ways to solve the problem are introduced in detail and systematically. Although the formulation and application of the principle of common but differentiated responsibilities has a very important influence on the containment of global warming, its status in international law is still not clear, so its maturity is not high. From a practical point of view, there are problems with the application of the principle of common but differentiated responsibilities. In reality, the principle not only lacks effective safeguards but also faces many practical challenges, although there are many problems in its application. However, the focus of the principle has always been on the distinction of responsibility, and the standard of differentiated responsibility should be formulated in a comprehensive way considering the time, subject, standard, quantity and form of the responsibility. The key point of this paper is to explore the concrete countermeasures to implement the principle of common but differentiated responsibilities. Building the capacity of developing countries to bear responsibilities is an important measure to implement the principle of common but differentiated responsibilities in practice. Industry can protect the environment while guaranteeing the economic benefits of developing countries, Therefore, this chapter focuses on idealism and emphasizes that the development of environmental protection industry is a new way to apply the principle of common but differentiated responsibilities in developing countries.
