【摘要】：2013年11月23日我國正式對外宣布劃設(shè)東海防空識(shí)別區(qū),有力地鞏固和保障了我國在東海海域的國防安全。一些國家對中國的這一行為提出了質(zhì)疑。為回應(yīng)這一質(zhì)疑,可以從不同角度為我國劃設(shè)東海防空識(shí)別區(qū)以及未來有可能劃設(shè)的南海防空識(shí)別區(qū)提供國際法理論的論證。即我國劃設(shè)防空識(shí)別區(qū)的行為是對于專屬經(jīng)濟(jì)區(qū)"剩余權(quán)利"理論的合理利用;符合"地空法律地位一致"原則;是對《聯(lián)合國憲章》中"自衛(wèi)權(quán)"的行使以及劃設(shè)防空識(shí)別區(qū)已構(gòu)成一項(xiàng)國際慣例,以此證明我國劃設(shè)防空識(shí)別區(qū)行為的正當(dāng)性。
[Abstract]:In November 23rd 2013, China officially declared the establishment of the East China Sea Air Defense Identification Zone, which has effectively consolidated and guaranteed China's national defense security in the East China Sea. Some countries have questioned China's behavior. In response to this query, It is possible to provide a theoretical proof of international law for the establishment of an air defense identification zone in the East China Sea and a possible air defense identification zone in the South China Sea from different angles. That is, the act of establishing an air defense identification zone in China is "leftover" for the exclusive economic zone. The reasonable utilization of the theory of "residual right"; In line with the principle of "consistent legal status between the ground and air", the exercise of the "right to self-defence" in the Charter of the United Nations and the establishment of an air defense identification zone constitute an international practice, thus proving the legitimacy of the act of establishing an air defense identification zone in China.
