【摘要】：BOT作為一種新型投資模式,在世界各國的發(fā)展程度不一,以發(fā)達(dá)國家的充分建設(shè)利用和較為完善的立法為主要的表現(xiàn)形式。利用外國投資者的先進(jìn)技術(shù),成熟經(jīng)驗和充裕的資金來使本國基礎(chǔ)建設(shè)得到充足的發(fā)展,土耳其總理厄扎爾首次提出BOT且積極將其運作于其國的基礎(chǔ)設(shè)施建設(shè)中并取得了不錯的效果。于是世界各國在反思本國基礎(chǔ)建設(shè)方面應(yīng)該探索的地方,BOT漸漸得到了重視且朝著各種模式交相發(fā)生著變化,而我國作為基礎(chǔ)設(shè)施建設(shè)欠發(fā)展的最大發(fā)展中國家,能夠放開視角將優(yōu)秀的外來資源引入使我國的基礎(chǔ)設(shè)施建設(shè)得到發(fā)展的同時也能滿足外來資金的復(fù)利產(chǎn)生,帶動就業(yè)帶動生產(chǎn)的發(fā)展,使得更多的投資者也能將自身的資金投入外國產(chǎn)生更廣泛的收益。 本文介紹的BOT的發(fā)展來看,我國BOT的發(fā)展還是居于落后的地位,運用對比和綜合分析的方法,結(jié)合外國的成功實踐和經(jīng)驗教訓(xùn)。發(fā)現(xiàn)我國對于外來資金的利用存在諸多的限制和顧慮,對于外來資金的進(jìn)入運用始終是帶著各種的桎梏,雖然外來資金的進(jìn)入有著很高的門檻和限制,我們需要更多的資金進(jìn)入,贏得外來投資者的青睞是我國基礎(chǔ)設(shè)施建設(shè)蓬勃發(fā)展的強(qiáng)勁勢頭所決定。 本文后期借鑒外國優(yōu)秀的BOT成功實例,在分析其成功的原因和存在的不足中,從而得知其主要的不足是與東道國的充分支持和有力的法律監(jiān)管保障分不開,英法海底隧項目等諸多著名的項目都是在各方的努力協(xié)調(diào)下得到發(fā)展。我國在這些成功的例子中發(fā)現(xiàn)我們需要借鑒的地方和不足。我們所要研究的是我國缺乏統(tǒng)一的BOT方面的法律法規(guī)能否解決日趨發(fā)展強(qiáng)勁的BOT所出現(xiàn)的糾紛矛盾,能否在外國投資者的需求和資金運用的不成熟中使中外雙方的利益都得到滿足。在可吸收外國資金存在的不能完全轉(zhuǎn)交經(jīng)營權(quán)的時候,我國的內(nèi)資利用水平卻有著好的發(fā)展勢頭,不用過多擔(dān)心國家主權(quán)不安穩(wěn)的問題,我國的內(nèi)資利用水平也能登上一個新的臺階,我國的內(nèi)資能夠在充分利用的前提下將我國的內(nèi)資投放到更遠(yuǎn)更廣的領(lǐng)域,使內(nèi)資得到跨國的發(fā)展,更全面的使得外國的經(jīng)濟(jì)發(fā)展中有著更多的中國投資者的身影。 我國充分利用外資和國內(nèi)私人投資者的投資資金,無論內(nèi)資還是外資能夠得到充足的利用實現(xiàn)資金本身充分的利用,我國需要完善的BOT專項法律,需要給予外國投資者充分的信心和鼓勵,需要賦予我國充分的國際形象來更好的使我國的經(jīng)濟(jì)基礎(chǔ)在國際上得到充足的維護(hù)。
[Abstract]:As a new type of investment mode, BOT has different levels of development in various countries all over the world. It takes the full construction and utilization of developed countries and relatively perfect legislation as the main manifestation, and makes use of the advanced technology of foreign investors. Mature experience and adequate financial resources to enable adequate development of the country's infrastructure, For the first time, Turkish Prime Minister Ozal proposed BOT and put it into operation in the infrastructure construction of his country and achieved good results. Pay attention to and change towards the intersection of various patterns, As the biggest developing country in the underdevelopment of infrastructure construction, our country can open up the angle of view to introduce excellent foreign resources into the development of infrastructure construction of our country, and at the same time, it can satisfy the compound interest of foreign capital. The growth of employment and production allows more investors to invest their own money in foreign countries to generate a wider range of benefits. The development of BOT introduced in this paper shows that the development of BOT in China is still in a backward position. Combining with the successful practice and experience of foreign countries, it is found that there are many restrictions and concerns about the utilization of foreign funds in our country, and the entry and application of foreign funds is always brought with various shackles. Although the entry of foreign capital has a high threshold and restrictions, we need more funds to enter, winning the favor of foreign investors is determined by the strong momentum of the vigorous development of infrastructure construction in China. In the later stage of this paper, we draw lessons from the successful examples of foreign BOT, and analyze the reasons and shortcomings of its success, and then we can see that its main deficiency is not separated from the full support of the host country and the strong legal supervision guarantee. Many famous projects, such as the British and French CHT project, have been developed in coordination with the efforts of all parties. In these successful examples, our country has found that we need to learn from the problems and shortcomings. What we want to study is the lack of unity in our country. First, can the BOT laws and regulations resolve the disputes arising from the increasingly strong BOT, Whether the interests of both Chinese and foreign parties can be satisfied in the immature needs of foreign investors and the use of funds. However, the level of domestic capital utilization in our country has a good momentum of development. There is no need to worry too much about the problem of unstable state sovereignty. Our domestic capital utilization level can also rise to a new level. The domestic capital of our country can put the domestic capital of our country into a far wider field under the premise of making full use of it, so that the domestic capital can get the transnational development, and make more Chinese investors in the economic development of foreign countries more comprehensive. Our country makes full use of the foreign capital and the domestic private investor's investment capital, whether the domestic capital or the foreign capital can be fully utilized to realize the full utilization of the fund itself, our country needs the perfect BOT special law. It is necessary to give enough confidence and encouragement to foreign investors and to give our country a full international image to make the economic foundation of our country fully maintained internationally.
