區(qū)域貿(mào)易環(huán)境協(xié)調(diào)法律機(jī)制研究

【摘要】:自由貿(mào)易與環(huán)境保護(hù)既有促進(jìn)又存在沖突,,國(guó)際社會(huì)為了協(xié)調(diào)二者的關(guān)系進(jìn)行了不懈的努力:WTO將環(huán)境問題和可持續(xù)發(fā)展納入其主要工作之一,并主要利用爭(zhēng)端解決機(jī)制來協(xié)調(diào)二者的沖突,但WTO貿(mào)易優(yōu)先的價(jià)值取向限制了其協(xié)調(diào)的步伐;歐盟和北美自由貿(mào)易區(qū)在貿(mào)易與環(huán)境的協(xié)調(diào)上發(fā)展迅速,二者均已形成了協(xié)調(diào)的法律機(jī)制并取得了良好的協(xié)調(diào)效果。 新興的中國(guó)—東盟自由貿(mào)易區(qū)在享受經(jīng)貿(mào)利益的同時(shí)也遭遇了許多環(huán)境問題,加強(qiáng)區(qū)域內(nèi)環(huán)境合作并構(gòu)建貿(mào)易與環(huán)境協(xié)調(diào)的法律機(jī)制有利于促進(jìn)自貿(mào)區(qū)的可持續(xù)發(fā)展。本文綜合運(yùn)用案例分析、比較分析等方法對(duì)相關(guān)問題進(jìn)行了系統(tǒng)的研究,分為以下五個(gè)部分: 第一章從貿(mào)易與環(huán)境的相互促進(jìn)和沖突入手,通過考察WTO對(duì)貿(mào)易與環(huán)境的協(xié)調(diào)和WTO與區(qū)域協(xié)調(diào)的關(guān)系,揭示出區(qū)域協(xié)調(diào)所具有的優(yōu)勢(shì),最后以區(qū)域協(xié)調(diào)的最新發(fā)展來表現(xiàn)了這一優(yōu)勢(shì)。 第二章選取了區(qū)域協(xié)調(diào)中比較典型的歐盟和北美自由貿(mào)易區(qū)進(jìn)行介紹,從貿(mào)易與環(huán)境協(xié)調(diào)的歷史發(fā)展入手,總結(jié)了它們各自的協(xié)調(diào)原則,并通過比較分析揭示出了這些原則在適用上的差別所在。 第三章介紹了歐盟通過征收碳稅、統(tǒng)一產(chǎn)品標(biāo)準(zhǔn)、簽訂自愿環(huán)境協(xié)議等措施和北美自由貿(mào)易區(qū)通過賦予多邊環(huán)境協(xié)議(MEAs)優(yōu)先適用地位、規(guī)定環(huán)境標(biāo)準(zhǔn)的等效承認(rèn)等措施來協(xié)調(diào)貿(mào)易與環(huán)境的關(guān)系,并通過比較分析指出了這些規(guī)則的異同及優(yōu)劣之處。 第四章闡述了歐盟強(qiáng)制性的司法爭(zhēng)端解決模式和北美自由貿(mào)易區(qū)“協(xié)商+仲裁”的準(zhǔn)司法爭(zhēng)端解決模式,并通過對(duì)爭(zhēng)端解決的程序及效果進(jìn)行分析的揭示出一個(gè)適合的爭(zhēng)端解決機(jī)制對(duì)一個(gè)區(qū)域性組織的重要意義所在。 第五章詳細(xì)闡述了中國(guó)—東盟自由貿(mào)易區(qū)貿(mào)易與環(huán)境協(xié)調(diào)法律機(jī)制的構(gòu)建。本章從自由貿(mào)易區(qū)貿(mào)易與環(huán)境協(xié)調(diào)的現(xiàn)狀及最新進(jìn)展入手,通過分析協(xié)調(diào)法律機(jī)制構(gòu)建的可行性及不利條件,揭示出自貿(mào)區(qū)具備構(gòu)建協(xié)調(diào)法律機(jī)制的條件,并就協(xié)調(diào)法律機(jī)制構(gòu)建的內(nèi)容進(jìn)行了詳細(xì)闡述。
[Abstract]:Free trade and environmental protection have both promotion and conflict. In order to coordinate the relationship between them, the international community has made unremitting efforts to integrate environmental issues and sustainable development into one of its main work. And mainly use the dispute settlement mechanism to coordinate the conflict between the two, but the value orientation of WTO trade priority limits its coordination step; The European Union and the North American Free Trade area have developed rapidly in the coordination of trade and environment, both of which have formed a coordinated legal mechanism and achieved a good coordination effect. The emerging China-ASEAN Free Trade area has encountered many environmental problems while enjoying the economic and trade benefits. Strengthening the regional environmental cooperation and constructing the legal mechanism of trade and environment coordination is beneficial to promote the sustainable development of the free trade area. The comparative analysis and other methods have carried on the systematic research to the related question, which is divided into the following five parts: The first chapter starts with the mutual promotion and conflict between trade and environment, and reveals the advantages of regional coordination by examining the coordination of trade and environment by WTO and the relationship between WTO and regional coordination. Finally, this advantage is demonstrated by the latest development of regional coordination. The second chapter introduces the typical European Union and North American Free Trade area in regional coordination, and summarizes their respective coordination principles from the historical development of trade and environment coordination. And through comparative analysis to reveal the differences in the application of these principles. The third chapter introduces the European Union through the collection of carbon taxes, unified product standards, signed voluntary environmental agreements and other measures and the North American Free Trade area through the granting of multilateral environmental agreements (Meas) priority status. The equivalent recognition of environmental standards is stipulated to coordinate the relationship between trade and environment, and the similarities and disadvantages of these rules are pointed out through comparative analysis. Chapter 4th expounds the compulsory judicial dispute settlement model of EU and the quasi-judicial dispute settlement model of "negotiated arbitration" in NAFTA. By analyzing the procedure and effect of dispute settlement, it reveals the importance of a suitable dispute settlement mechanism to a regional organization. Chapter 5th elaborates the construction of the legal mechanism of trade and environment coordination in China-ASEAN Free Trade area. This chapter starts with the current situation and the latest progress of the trade and environment coordination of the Free Trade area. By analyzing the feasibility and unfavorable conditions of the construction of the coordinated legal mechanism, this paper reveals that the trade zone has the conditions for constructing the coordinated legal mechanism, and expounds in detail the contents of the construction of the coordinated legal mechanism.
