【摘要】：伊朗核問題引發(fā)了聯(lián)合國、歐盟和美國對其進行的經(jīng)濟制裁。聯(lián)合國通過的對伊朗制裁決議構(gòu)成各成員國的義務(wù)。歐盟和美國對伊朗制裁的立法,已全面禁止歐盟區(qū)域內(nèi)和美國國內(nèi)幾乎所有與伊朗有關(guān)的貿(mào)易往來和貨物運輸。然而,為達到其政治和經(jīng)濟的目的,歐盟和美國不斷修改制裁法,使其單邊制裁在域外產(chǎn)生效力,適用于全球的航運經(jīng)營者。這對我國公司開展伊朗業(yè)務(wù)產(chǎn)生了重大影響。 本文通過分析聯(lián)合國、歐盟和美國對伊朗制裁的現(xiàn)狀,總結(jié)出各制裁法的適用主體和對國際進出口貨物種類的限制。通過分析租船合同合法貨物所適用的國內(nèi)、國際法依據(jù)、美國和歐盟對伊朗制裁法的域外效力,進而總結(jié)出目前國際上對伊朗制裁的各項措施,對租船合同合法貨物產(chǎn)生的影響。 本文分三章進行論述,第一章介紹目前對伊朗制裁的立法情況和貨物限制。第二章分析判斷租船合同合法貨物的國內(nèi)法和國際法依據(jù),其中以我國《刑法》中相關(guān)規(guī)定為例進行研究。第三章探討美國和歐盟單邊制裁法對判斷貨物是否合法時的效力,并對租船合同當(dāng)事人提供了幾點建議。
[Abstract]:The Iran nuclear issue led to the United Nations, the European Union and the United States for economic sanctions by the United Nations resolution on sanctions against Iran constitute the obligations of the member states. The European Union and the United States legislation of sanctions against Iran, has banned in European region and the United States and Iran almost all the domestic trade and transport of goods. However,, to achieve its political and economic purposes, the European Union and the United States continue to modify the law sanctions, unilateral sanctions in the extraterritorial effect, suitable for global shipping operators. It had a great influence on our company to carry out business in Iran.
In this paper, through the analysis of the United Nations, the European Union and the United States the status quo of sanctions against Iran, summed up the subject of the sanctions law and restrictions on international import and export cargo types. Through the analysis of the contract legal goods for domestic and international law basis, the effectiveness of the United States and the European Union on Iran sanctions extraterritorial law, and summed up the the current measures of international sanctions against Iran, on charter legal goods produced.
This paper is divided into three chapters, the first chapter introduces the current legislative situation of sanctions against Iran and cargo restrictions. In the second chapter, analysis and judgment of charter party legitimate goods of domestic law and international law basis, with China's criminal law the relevant provisions stipulated in the < > as the case study. The third chapter discusses the United States and the EU unilateral sanctions on the judgement of effectiveness the goods are legal, and some suggestions on the charter party.
