【摘要】：在走向現(xiàn)代企業(yè)制度的過程中，我國企業(yè)根據(jù)《公司法》的規(guī)定，參照國際慣例，在形式上基本建立起了法人制度，但是對公司內(nèi)部的管理還沒有完善，，甚至還存在著十分嚴重的問題。其中最關(guān)鍵的問題是對企業(yè)的經(jīng)營者（經(jīng)理、廠長）缺乏有效的司法監(jiān)督，致使國有資產(chǎn)損失巨大，...
[Abstract]:In the process of moving towards a modern enterprise system, Chinese enterprises, in accordance with the provisions of the Company Law and referring to international practice, have basically established a legal person system in form, but the internal management of the company has not yet been improved. There are even serious problems. Among them, the most critical problem is the lack of effective judicial supervision on the managers (managers, factory directors) of the enterprises, resulting in huge losses of state-owned assets.
