【摘要】：2006年1月1日起正式施行的新《公司法》,是對93年《公司法》的全面修訂,也是歷年來規(guī)模最大的一次修訂。新《公司法》不論是在立法理念上,還是在一些具體規(guī)則的制定上,都較過去做出了很大的變動。商業(yè)銀行作為公司的主要債權(quán)人,其利益不可避免地會受到影響,并需要做出相應(yīng)的調(diào)整。本文擬就新公司法對銀行信貸業(yè)務(wù)風(fēng)險管理的影響,及銀行對策做一番討論。
[Abstract]:The new Company Law, which was formally implemented on January 1, 2006, is a comprehensive revision of the Company Law of 1993 and the largest revision in the past years. The new Company Law has made great changes both in the legislative concept and in the formulation of some specific rules. As the main creditor of the company, commercial banks have their benefits. Benefits will inevitably be affected and need to be adjusted accordingly. This paper intends to discuss the impact of the new company law on risk management of bank credit business and bank countermeasures.
