【摘要】: 企業(yè)社會責任是指企業(yè)在謀求股東利潤最大化之外所負有的維護和增進社會利益的義務,是對企業(yè)絕對營利性的修正,是建構企業(yè)與社會和諧關系的一種基本思想。商業(yè)銀行以金融資產和負債為經(jīng)營對象,其業(yè)務的公共性和社會性決定了其承擔社會責任的正當性和必然性。 商業(yè)銀行社會責任的內容具有特殊性,在一般生產型企業(yè)比較突出的人權保障、勞工權益和公共環(huán)境保護問題等方面并不那么引人關注。商業(yè)銀行的社會責任有直接的責任對象,商業(yè)銀行社會責任的內容應以利益相關者為中心,對債權人的社會責任表現(xiàn)為構建全面的風險管理體系,對資金需求者負有效率配置資金社會責任,對消費者的社會責任主要是提供優(yōu)質服務。商業(yè)銀行通過貸款方向、對象控制,履行對環(huán)境和資源的間接的社會責任,此外,對弱勢群體的慈善責任也是商業(yè)銀行社會責任的題中之義。 現(xiàn)階段,我國商業(yè)銀行承擔了一定的社會責任,但從總體上看,商業(yè)銀行社會責任觀念匱乏,有關社會責任的法律法規(guī)等強制性規(guī)范的缺位,國內商業(yè)銀行履行社會責任缺乏系統(tǒng)性,隨意性很大。通過對企業(yè)社會責任與法定義務關系的考察,不難得知,道德義務與法定義務之間其實“只有一種遙遠而直接的關系”,企業(yè)杜會責任已經(jīng)超越道德教化,法定義務是企業(yè)社會責任具體落實的發(fā)展趨勢。因此,必須通過制度上的設計和立法上的吸納,將商業(yè)銀行社會責任落實到商業(yè)銀行的經(jīng)營行為中。在目前這個大環(huán)境下,要使得社會責任成為銀行的自覺行動和普遍行為,需要從宏觀、中觀和微觀三個層次來構建商業(yè)銀行社會責任的整體框架,需要一個不斷完善的法制環(huán)境來強制,一個良好的政府來引導,一個不斷發(fā)展的行業(yè)組織來監(jiān)督,一個適宜的公司治理結構來控制,以及濃厚的企業(yè)文化來鞏固。
[Abstract]:Corporate social responsibility (CSR) refers to the obligation for enterprises to maintain and promote social interests beyond the maximization of shareholders' profits. It is a revision of the absolute profitability of enterprises and a basic idea of constructing a harmonious relationship between enterprises and society.Commercial banks take financial assets and liabilities as their business objects. The commonality and sociality of their business determines the legitimacy and inevitability of their social responsibility.The content of commercial bank's social responsibility has its particularity, and it is not so noticeable in the aspects of human rights protection, labor rights and interests and public environmental protection.The social responsibility of commercial banks has direct responsibility object, the content of social responsibility of commercial banks should take the stakeholders as the center, and the social responsibility to the creditors should be reflected in the construction of a comprehensive risk management system.The social responsibility for the efficient allocation of funds to the capital demanders, and the social responsibility for consumers is mainly to provide quality services.Commercial banks perform indirect social responsibility to environment and resources through the direction of loan, object control, and charity responsibility to vulnerable groups is also the meaning of social responsibility of commercial banks.At the present stage, commercial banks in our country have assumed certain social responsibilities, but generally speaking, the concept of social responsibility of commercial banks is scarce, and the laws and regulations on social responsibility are absent.The domestic commercial bank performs the social responsibility lacks the system, the arbitrariness is very big.Through the investigation of the relationship between corporate social responsibility and legal obligation, it is not difficult to know that the relationship between moral obligation and legal obligation is "only a distant and direct relationship", and the corporate social responsibility has gone beyond moral enlightenment.The legal obligation is the development trend of the implementation of corporate social responsibility.Therefore, it is necessary to implement the social responsibility of commercial banks into the management behavior of commercial banks through institutional design and legislative absorption.In the present environment, in order to make social responsibility become the conscious action and universal behavior of banks, it is necessary to construct the overall framework of social responsibility of commercial banks from three levels: macro, meso and micro.
