【摘要】：正當(dāng)前一段時(shí)間以來(lái),因受國(guó)際金融危機(jī)和世界經(jīng)濟(jì)衰退的影響,公司經(jīng)營(yíng)困難引發(fā)的公司強(qiáng)制清算案件大幅度增加。雖然公司法和最高人民法院《關(guān)于適用公司法若干問(wèn)題的規(guī)定(二)》(以下簡(jiǎn)稱公司法司法解釋(二))對(duì)公司強(qiáng)制清算案件審理中的有關(guān)問(wèn)題已作出規(guī)定,但鑒于該類案件非訟程序的特點(diǎn)和目前清算
[Abstract]:Just before a period of time, due to the impact of the international financial crisis and the global economic recession, the company operating difficulties caused by the cases of compulsory liquidation of companies greatly increased. Although the company law and the Supreme People's court "on issues concerning the application of the provisions of company law (two)" (hereinafter referred to the company law judicial interpretation (two)) the relevant issues in the case of compulsory liquidation of the company have been made, but in view of the characteristics of such cases and the liquidation of non litigation procedure
