【摘要】：本文通過(guò)對(duì)近期的《中華人民共和國(guó)公司法》譯本的分析以及與國(guó)外類(lèi)似法律文本和國(guó)內(nèi)早期法律譯本的對(duì)比,發(fā)現(xiàn)當(dāng)今中國(guó)法律英譯已經(jīng)進(jìn)入一個(gè)崇尚和濫用古舊詞的誤區(qū)。在英文法律文本中頻繁使用古舊詞是一種不良文風(fēng),與當(dāng)今法律語(yǔ)言發(fā)展的總體趨勢(shì)背道而馳。為此,筆者在文內(nèi)首次提出并論證了古舊詞使用的四項(xiàng)專用原則:一、簡(jiǎn)明作文原則;二、讀者理解和認(rèn)可原則;三、用詞經(jīng)濟(jì)原則;四、用詞可重復(fù)原則。在法律英譯或?qū)懽髦?筆者建議以這四項(xiàng)原則為指引,慎用或盡可能少用古舊詞。
[Abstract]:This paper analyzes the recent versions of the Company Law of the people's Republic of China and compares them with similar legal texts in foreign countries and early legal versions in China. It is found that the English translation of Chinese laws has entered a misunderstanding of advocating and abusing ancient words. The frequent use of old words in English legal texts is a bad style of writing, which runs counter to the general trend of the development of legal language. In this paper, for the first time, the author puts forward and demonstrates four special principles for the use of ancient words: first, the principle of concise composition; second, the principle of reader understanding and approval; third, the principle of word-economy; fourth, the principle of repeatability of words. The author suggests that the four principles should be used with caution or as little as possible.
