【摘要】：為了更好地構(gòu)建和諧社會，充分發(fā)揮人民調(diào)解對于糾紛解決的作用，在科學(xué)發(fā)展觀的指導(dǎo)下完善人民調(diào)解工作機(jī)制，充分發(fā)揮人民調(diào)解員的主觀能動性，確保調(diào)解協(xié)議的效力，切實有效化解矛盾糾紛，構(gòu)建社會主義和諧社會。本文采用比較的方法、歸納總結(jié)的方法和社會學(xué)、法律社會學(xué)、法律文化學(xué)等多學(xué)科研究方法從理論角度詳細(xì)分析人民調(diào)解工作現(xiàn)狀，本文以作者多年在基層司法所從事人民調(diào)解工作為例，從實踐角度分析人民調(diào)解工作中存在的問題，進(jìn)而嘗試系統(tǒng)地提出改革和完善的建議。具體內(nèi)容包括： 第一章，緒論。包括選題背景、研究現(xiàn)狀、研究意義、研究方法和思路、機(jī)構(gòu)安排五個方面。特殊的社會時期對于人民統(tǒng)計工作提出新的要求，利用人民調(diào)解這種便捷的糾紛化解方式化解新時期各類矛盾糾紛，是發(fā)展的大勢所趨。 第二章，人民調(diào)解與科學(xué)發(fā)展觀。對人民調(diào)解與科學(xué)發(fā)展觀的內(nèi)涵、要義、基本理論進(jìn)行了簡單闡述，同時，指出科學(xué)發(fā)展觀對于人民調(diào)解工作的指導(dǎo)意義。 第三章，人民調(diào)解工作的現(xiàn)狀及問題。通過分析現(xiàn)階段工作中人民調(diào)解組織、人民調(diào)解員、調(diào)解范圍、協(xié)議效力、經(jīng)費(fèi)保障等幾個方面的現(xiàn)狀，得出人民調(diào)解工作組織不健全、人員素質(zhì)不高、工作范圍狹窄、協(xié)議履行障礙、經(jīng)費(fèi)不足等等一系列存在的問題，為下一步解決問題提供了鋪墊和引導(dǎo)。 第四章，科學(xué)發(fā)展觀對于現(xiàn)行人民調(diào)解工作的創(chuàng)新。從第三章分析存在的問題入手，圍繞人民調(diào)解工作須圍繞“自治性”原則解決矛盾糾紛，“以人為本”的要求解決好人民調(diào)解員的素質(zhì)和待遇，從當(dāng)事人的角度通過德法建設(shè)保障協(xié)議的實際履行，積極提倡和構(gòu)建“大調(diào)解”工作格局，，維護(hù)社會和諧穩(wěn)定。 通過以上舉措，解決好人民調(diào)解工作機(jī)構(gòu)、人力、財力、方法等具體問題后，人民調(diào)解工作才能煥發(fā)新的生機(jī)和活力�？茖W(xué)發(fā)展觀正是從這幾個人方面推動人民調(diào)解工作向縱深發(fā)展的法寶和利劍，科學(xué)發(fā)展觀指引下，確保人民調(diào)解組織的“自治性”和發(fā)揮人的主觀能動性，正是馬克思主義群眾觀點(diǎn)的創(chuàng)新和提煉。正如胡錦濤總書記所說：“人民調(diào)解是中國的特色，要變被動調(diào)解為主動調(diào)解，深入開展矛盾糾紛的排查調(diào)處工作�！比嗣裾{(diào)解工作只有調(diào)動參與者的積極性，定能為社會主義建設(shè)提供穩(wěn)定的社會環(huán)境和巨大的支持力量。
[Abstract]:In order to build a harmonious society and give full play to the role of the people's mediation in the settlement of disputes, under the guidance of the scientific concept of development, the working mechanism of the people's mediation should be perfected, the subjective initiative of the people's mediators should be brought into full play, and the effectiveness of the mediation agreement should be ensured. We will effectively resolve conflicts and disputes and build a harmonious socialist society. This article uses the comparative method, summarizes the method and sociology, legal culture and other multidisciplinary research methods from the theoretical point of view to analyze the current situation of the people's mediation work in detail. Taking the author as an example who has been engaged in the people's mediation work in the grass-roots judicial institute for many years, this paper analyzes the problems existing in the people's mediation work from the point of view of practice, and then attempts to systematically put forward some suggestions for reform and perfection. The concrete content includes: the first chapter, the introduction. Including the background of the topic, research status, research significance, research methods and ideas, institutional arrangements five aspects. It is the general trend of development to put forward new requirements for the people's statistical work in the special social period, and to resolve all kinds of contradictions and disputes in the new period by using the convenient dispute resolution method of the people's mediation. Chapter two, people's mediation and scientific development view. This paper briefly expounds the connotation, essential meaning and basic theory of people's mediation and scientific development view, and points out the guiding significance of scientific development view to people's mediation work. Chapter III, the current situation and problems of the people's mediation work. By analyzing the present situation of the people's mediation organization, the people's mediators, the mediation scope, the validity of the agreement, the guarantee of funds and so on, it is concluded that the organization of the people's mediation work is not perfect, the quality of the personnel is not high, and the scope of the work is narrow. A series of problems, such as obstacles to the implementation of the agreement, lack of funds and so on, provide the foundation and guidance for the next step to solve the problems. The fourth chapter, the scientific development view to the current people mediation work innovation. Starting with the analysis of the existing problems in the third chapter, the people's mediation work should focus on the principle of "autonomy" to resolve contradictions and disputes, and the requirement of "people-oriented" to resolve the quality and treatment of the people's mediators. From the point of view of the parties, through the actual implementation of the guarantee agreement on the construction of Germany and France, we actively advocate and construct the working pattern of "great mediation" to maintain social harmony and stability. Through the above measures, the people's mediation work can be revitalized only by solving the specific problems such as people's mediation institutions, manpower, financial resources, methods and so on. The scientific concept of development is precisely the magic weapon and sword that promotes the people's mediation work to develop in depth from these aspects. Under the guidance of the scientific development view, it ensures the "autonomy" of the people's mediation organization and gives full play to the subjective initiative of the people. It is the innovation and refinement of Marxist views of the masses. As General Secretary Hu Jintao said: "people's mediation is a characteristic of China, and it is necessary to turn passive mediation into active mediation and carry out in-depth investigation and mediation of contradictions and disputes." The people's mediation work can only mobilize the enthusiasm of the participants, can provide a stable social environment and huge support for socialist construction.
