【摘要】：罪犯教育是指我國監(jiān)獄機(jī)關(guān)對罪犯依法執(zhí)行刑罰的過程中,為了實現(xiàn)刑罰的目的,在思想品德、文化知識、職業(yè)技術(shù)和社會生活等方面進(jìn)行的具有強(qiáng)制性、再塑性的,有組織、有計劃的系統(tǒng)影響活動。在理論上講罪犯教育可以分為廣義的罪犯教育,即罪犯在監(jiān)獄從事的一切自覺和不自覺的勞動、學(xué)習(xí),它們均有教育意義；而狹義的罪犯教育指對監(jiān)管的罪犯進(jìn)行的思想、文化、技能教育,是一種區(qū)別于普通教育的特殊教育形式。本文所說的是廣義的罪犯教育,筆者試圖以歷史的視角對這一特殊教育進(jìn)行研究。本文將新中國罪犯教育劃分為四個階段：第一階段是新中國成立初期(1949-1956)的罪犯教育；第二階段是社會主義革命和建設(shè)時期(1956-1966)的罪犯教育；第三階段是“文化大革命時期”(1966-1976)的罪犯教育,由于這一階段的特殊性,本文的闡述是通過一些極端的案例對這一時期的罪犯教育及社會背景進(jìn)行分析,從中總結(jié)經(jīng)驗教訓(xùn),提出警示；第四階段是社會轉(zhuǎn)型期(1978-2008)的罪犯教育。每個階段對其歷史背景、政策、法律法規(guī)進(jìn)行了梳理和回顧。最后,筆者對新中國罪犯教育的成就進(jìn)行了總結(jié),并對“和諧社會”構(gòu)建下的罪犯教育進(jìn)行分析并提出新的見解。本文從歷史的視角較深入地研究罪犯教育的發(fā)生、發(fā)展以及變化的規(guī)律,對新中國罪犯教育歷史進(jìn)行一次全面的回顧,對罪犯教育工作的得失進(jìn)行一次全方位的總結(jié),以期對今后監(jiān)獄工作的發(fā)展進(jìn)行展望。
[Abstract]:Criminal education refers to the compulsory, replastic, organized and organized process carried out by the prison authorities of our country in the course of carrying out the punishment according to law, in order to achieve the purpose of the penalty, in terms of ideological and moral character, cultural knowledge, professional technology and social life, etc. Planned system impact activities. In theory, criminal education can be divided into a broad sense of criminal education, that is, all the conscious and involuntary work and study of criminals in prison, they all have educational significance; In a narrow sense, criminal education refers to the thought, culture and skill education of the supervised criminals, which is a special education form different from general education. The author tries to study this special education from the perspective of history. This paper divides the criminal education of New China into four stages: the first stage is the criminal education in the initial period of the founding of New China (1949-1956), the second stage is the criminal education in the period of socialist revolution and construction (1956-1966). The third stage is the criminal education in the period of "Cultural Revolution" (1966-1976). Because of the particularity of this stage, this paper analyzes the criminal education and social background of this period through some extreme cases. Summing up the experience and lessons, and putting forward the warning; The fourth stage is the criminal education in the social transition period (1978-2008). Each stage of its historical background, policies, laws and regulations are combed and reviewed. Finally, the author summarizes the achievements of criminal education in New China, analyzes the criminal education under the construction of "harmonious society" and puts forward some new opinions. From the perspective of history, this paper makes a thorough study of the occurrence, development and changing law of criminal education, reviews the history of criminal education in New China, and summarizes the gains and losses of criminal education in an all-round way. With a view to the future development of prison work.
