【摘要】：隨著案件集中管理機制改革在全國檢察機關的全面推行,案件管理部門對各類檢察業(yè)務案件監(jiān)管工作已全面展開,為規(guī)范、指導案件管理部門的監(jiān)管,應制定具體的監(jiān)管規(guī)程,使案件管理更加有據(jù)可依、有章可循。構建檢察業(yè)務案件監(jiān)管規(guī)程,需遵循內(nèi)部監(jiān)督與法律監(jiān)督并重、程序監(jiān)管與實體監(jiān)管并重、全程管理與動態(tài)監(jiān)督相結合等原則,并對案件程序監(jiān)管要素、實體監(jiān)管要素以及案件文書監(jiān)管要素進行內(nèi)容設定。案件管理部門可在平臺監(jiān)管、文書備案審查、案件檢查考評等方面對各類檢察業(yè)務案件實施監(jiān)管,通過案件承辦人反饋、向案件承辦部門通報、對監(jiān)管情況進行整改跟蹤等方式,增強對監(jiān)管結果的靈活運用。
[Abstract]:With the comprehensive implementation of the reform of the centralized case management mechanism in the procuratorial organs throughout the country, the case management departments have carried out the supervision work of various procuratorial business cases in an all-round way. In order to standardize and guide the supervision of the case management departments, specific supervision regulations should be formulated. To make the case management more evidence-based, there are rules to follow. To construct the supervision rules of procuratorial cases, we should follow the principles of internal supervision and legal supervision, procedural supervision and entity supervision, the combination of whole process management and dynamic supervision, and the elements of case procedure supervision. Substantive regulatory elements and case document regulatory elements for content setting. The case management department may supervise all kinds of procuratorial business cases in the aspects of platform supervision, document filing and examination, case inspection and evaluation, etc., and inform the case undertaking department through the feedback of the case organizer, To monitor the situation and track the way to enhance the flexible use of regulatory results.
