【摘要】：我國(guó)艾滋病犯罪人員具有犯罪有恃無(wú)恐、犯罪后果嚴(yán)重、人格心理扭曲、仇視報(bào)復(fù)社會(huì)、依賴犯罪收入、社會(huì)關(guān)系和家庭關(guān)系緊張的特征。艾滋病犯罪人員具有社會(huì)危害性,同時(shí)又屬于社會(huì)弱勢(shì)群體。懲罰艾滋病犯罪人員方面存在刑罰執(zhí)行難等問題,所以在懲治艾滋病犯罪人員的過(guò)程中,可以通過(guò)限制對(duì)該特殊群體適用暫予監(jiān)外執(zhí)行、完善關(guān)押場(chǎng)所的各種設(shè)施、提高司法機(jī)關(guān)工作人員防護(hù)能力的措施,切實(shí)將艾滋病犯罪人員關(guān)押或收監(jiān),落實(shí)對(duì)此類犯罪主體的懲罰,形成對(duì)此類犯罪的威懾力,以避免他們?cè)诶硇赃x擇下實(shí)施犯罪,維護(hù)法律的尊嚴(yán)。此外,我國(guó)在矯正艾滋病犯罪人員方面也存在矯正部門單一、矯正環(huán)節(jié)單一、未重視艾滋病犯罪人員親屬的矯正作用等問題,可以通過(guò)設(shè)立艾滋病患者關(guān)愛中心和完善各種犯罪矯正措施,提高犯罪矯正效果,消除他們出獄后的緊張狀態(tài)和緊張情緒,解決艾滋病犯罪人員再犯罪率高的問題。一方面要對(duì)艾滋病犯罪人員的犯罪行為加以嚴(yán)格懲罰,另一方面要根據(jù)艾滋病犯罪人員的社會(huì)弱勢(shì)性進(jìn)行有針對(duì)性的矯正和保護(hù),并認(rèn)定對(duì)艾滋病犯罪人員的懲罰和矯正具有統(tǒng)一性關(guān)系。只有同等重視懲罰和矯正,使懲罰和矯正相互配合形成合力,才能根治此類犯罪問題。
[Abstract]:AIDS criminals in China have the characteristics of bullying, serious consequences, distorted personality, hate to retaliate society, dependent on crime income, social relations and family relations. AIDS criminals have social harm, but also belong to the social vulnerable groups. There are some problems in punishing AIDS criminals, such as the difficulty of enforcing punishment. So in the process of punishing AIDS criminals, we can improve the facilities in places of detention by restricting the application of temporary execution to this special group. Measures to improve the protective capacity of judicial staff, to effectively detain or detain AIDS criminals, to implement penalties on the subject of such crimes, and to form a deterrent against such crimes, so as to prevent them from committing crimes at their rational choice. Uphold the dignity of the law. In addition, there are also problems in correcting AIDS criminals in China, such as a single correction department, a single correction link, and a lack of attention to the corrective role of the relatives of AIDS criminals. We can set up care center for AIDS patients and perfect all kinds of crime correction measures, improve the effect of crime correction, eliminate the tension and tension after they get out of prison, and solve the problem of high crime rate of AIDS criminals. On the one hand, it is necessary to strictly punish the criminal acts of AIDS criminals, and on the other hand, it is necessary to carry out targeted correction and protection according to the social vulnerability of AIDS criminals. And that the punishment and correction of AIDS offenders have a unified relationship. Only if we attach equal importance to punishment and correction, and make punishment and correction cooperate and form a joint force, can we cure this kind of crime.
