【摘要】：檢察機(jī)關(guān)“舉報(bào)制度”是全國(guó)各級(jí)人民檢察院依照法律規(guī)定受理公民、法人及其他組織依法控告、揭發(fā)國(guó)家機(jī)關(guān)工作人員貪污賄賂、瀆職以及利用職權(quán)實(shí)施犯罪等職務(wù)犯罪活動(dòng)線索并依法進(jìn)行查處,保障憲法所賦予的公民控告檢舉權(quán)有效實(shí)施的一項(xiàng)重要制度。最高人民檢察院為此專門(mén)頒行了《人民檢察院舉報(bào)工作規(guī)定》,以此來(lái)規(guī)范全國(guó)各級(jí)人民檢察院的受理舉報(bào)工作。但隨著我國(guó)改革走向深入,貪腐瀆職現(xiàn)象日益復(fù)雜化,筆者在多年的具體實(shí)務(wù)工作過(guò)程中發(fā)現(xiàn)檢察機(jī)關(guān)“舉報(bào)制度”中存在著受理“村官”職務(wù)犯罪案件范圍不明確、對(duì)舉報(bào)人保護(hù)不力、舉報(bào)中心無(wú)法監(jiān)督自偵部門(mén)這三方面的問(wèn)題,且問(wèn)題日益嚴(yán)峻,嚴(yán)重?fù)p傷了人民群眾的舉報(bào)熱情,影響了檢察機(jī)關(guān)查辦職務(wù)犯罪工作的順利開(kāi)展,也使得具體實(shí)務(wù)工作無(wú)所適從。為了解決這三個(gè)突出問(wèn)題,筆者采取分析、比較和實(shí)證等研究方法,首先對(duì)檢察機(jī)關(guān)舉報(bào)制度的界定和沿革、其所追求的價(jià)值目標(biāo)和基本原則進(jìn)行了闡述,其次在分析產(chǎn)生問(wèn)題的根源的同時(shí),借鑒國(guó)外“舉報(bào)制度”對(duì)類似問(wèn)題的解決辦法,最后有針對(duì)性地提出了完善檢察機(jī)關(guān)受理“村官”職務(wù)犯罪范圍的法律規(guī)定、建立健全保護(hù)舉報(bào)人制度、加強(qiáng)檢察機(jī)關(guān)內(nèi)設(shè)機(jī)構(gòu)的監(jiān)督制約機(jī)制改革三個(gè)完善方案。筆者希望這三個(gè)完善方案能夠?yàn)闄z察機(jī)關(guān)“舉報(bào)制度”的改革提供一些參考意見(jiàn),同時(shí)解決具體實(shí)務(wù)工作無(wú)所適從的窘境。
[Abstract]:The "report system" of procuratorial organs is that the people's procuratorates at all levels throughout the country, in accordance with the provisions of the law, accept complaints against citizens, legal persons and other organizations, and expose corruption and bribery of functionaries of state organs. Dereliction of duty and the use of power to commit crimes and other official criminal activities clue and investigate and deal with according to law, to ensure that the Constitution of citizens to effectively carry out the right to prosecute an important system. For this reason, the Supreme people's Procuratorate has promulgated the regulations on reporting by the people's Procuratorates, thus standardizing the acceptance of reports by people's procuratorates at all levels throughout the country. However, with the deepening of reform in our country, the phenomenon of corruption and dereliction of duty is becoming more and more complicated. During my years of practical work, the author found that the scope of accepting "village official" duty crime cases in the procuratorial organ's "report system" is not clear. The lack of protection of whistleblowers and the inability of the reporting center to supervise the self-investigating departments are becoming increasingly serious, seriously damaging the people's enthusiasm for reporting, and affecting the smooth development of the procuratorial organs' investigation and handling of job-related crimes. It also makes the concrete practical work at a loss. In order to solve these three outstanding problems, the author adopts the methods of analysis, comparison and demonstration. Firstly, the author expounds the definition and evolution of the procuratorial organ's reporting system, the value objectives and basic principles it pursues. Secondly, by analyzing the root causes of the problems, drawing lessons from the "report system" in foreign countries to solve similar problems, the author puts forward the legal provisions to perfect the scope of the procuratorial organs accepting the crimes committed by the "village officials". Establishing and perfecting the system of protecting whistleblowers and strengthening the supervision and restriction mechanism of procuratorial organs. The author hopes that these three perfect schemes can provide some suggestions for the reform of the "reporting system" of procuratorial organs, and at the same time solve the dilemma of concrete practical work.
