【摘要】：獄內(nèi)偵查權(quán)是法律賦予監(jiān)獄機(jī)關(guān)的一項司法權(quán)力，獄內(nèi)偵查工作又是監(jiān)獄機(jī)關(guān)工作的重要組成部分，它在維護(hù)監(jiān)獄安全穩(wěn)定，提高罪犯改造質(zhì)量方面發(fā)揮著不可估量的作用。 特別是近年來隨著社會的發(fā)展，監(jiān)獄押犯構(gòu)成日趨復(fù)雜，涉黑犯罪、暴力犯罪和高科技犯罪日益增多，管理和教育罪犯的難度也日漸加大，監(jiān)獄管理工作面臨著前所未有的嚴(yán)峻形勢。如何更好地穩(wěn)定監(jiān)管安全形勢，有效地防范和打擊獄內(nèi)犯罪，進(jìn)而確保社會安定和諧就成為監(jiān)獄機(jī)關(guān)工作的重中之重。而獄內(nèi)偵查工作的好壞直接決定了監(jiān)獄機(jī)關(guān)維穩(wěn)能力的高低，因此在新形勢下加強(qiáng)獄內(nèi)偵查工作就迫在眉睫。 雖然我國的獄內(nèi)偵查工作在新中國成立之后經(jīng)過60多年的努力探索取得了長足的發(fā)展。但在當(dāng)前監(jiān)獄工作面臨前所未有嚴(yán)峻形勢的大背景下，我國獄內(nèi)偵查工作現(xiàn)狀仍然可以用“發(fā)展緩慢，人員匱乏，技術(shù)薄弱，效率低下”16個字來概括。制度不完善、組織網(wǎng)絡(luò)不健全、隊伍缺乏專業(yè)化以及裝備與經(jīng)費匱乏致使工作效率低下等問題和矛盾比較突出，要充分發(fā)揮獄內(nèi)偵查的功能，就必須破解這些難題，在法律法規(guī)、規(guī)章制度和隊伍建設(shè)等方面取得質(zhì)的突破。 本文在總結(jié)歸納前人研究結(jié)果的基礎(chǔ)上，結(jié)合筆者在工作中遇到的實際情況，，著力從獄內(nèi)偵查的概念、發(fā)展進(jìn)行溯本清源的追思，理清獄內(nèi)偵查和相關(guān)法律的界限，并對我國獄內(nèi)偵查的現(xiàn)狀進(jìn)行細(xì)致分析，再通過考察國際上部分國家獄內(nèi)偵查有關(guān)情況，進(jìn)而提出了健全對獄內(nèi)偵查的憲法性保障、完善有關(guān)獄內(nèi)偵查的立法和建立配套的獄內(nèi)偵查工作機(jī)制等有針對性的解決方案，力求為提升監(jiān)獄機(jī)關(guān)預(yù)防打擊獄內(nèi)犯罪能力提供一些借鑒，為今后法律法規(guī)的建立健全提供一些依據(jù)。
[Abstract]:The power of investigation in prison is a judicial power conferred by law on the prison organs, and the investigation in prison is an important part of the work of the prison organs. It plays an inestimable role in maintaining the security and stability of the prison and improving the quality of the reform of criminals. In particular, with the development of society in recent years, the composition of prisoners in prison is becoming more and more complex, the crime involving criminal, violent crime and high-tech crime are increasing day by day, and the difficulty of managing and educating criminals is also increasing day by day. Prison management is facing an unprecedented severe situation. How to better stabilize the security situation of supervision, effectively prevent and crack down on crime in prison, and then ensure social stability and harmony has become the most important work of prison organs. The quality of the investigation in prison directly determines the ability of the prison organs to maintain stability, so it is urgent to strengthen the investigation work in prison under the new situation. Although our country's inside-prison investigation work has made great progress after the founding of new China after more than 60 years of hard work. However, under the background that the prison work is facing an unprecedented and severe situation, the present situation of the investigation in prison in our country can still be summed up with 16 words: "slow development, lack of personnel, weak technology and low efficiency". Problems and contradictions such as imperfect system, imperfect organization and network, lack of specialization of the team and lack of equipment and funds lead to inefficiency problems and contradictions. In order to give full play to the functions of investigation in prison, we must solve these problems. In the laws and regulations, rules and regulations and team building and other aspects of qualitative breakthroughs. On the basis of summing up the previous research results and combining with the actual situation encountered by the author in his work, this paper focuses on the concept of the investigation inside the prison, develops the thinking of tracing back to the source of the Qing Dynasty, and clarifies the boundaries between the investigation inside the prison and the relevant laws. It also makes a detailed analysis of the present situation of the investigation in prison in our country, and then through the investigation of the relevant situation in some countries in the world, it puts forward the constitutional guarantee of the investigation in the prison. To perfect the relevant legislation on the investigation in prison and to establish the corresponding mechanism of the investigation in prison, and to provide some reference for improving the capacity of the prison authorities to prevent and crack down on the crime inside the prison, To provide some basis for the establishment of laws and regulations in the future.
