我國法院執(zhí)行公共政策的機制分析——以法院為“一帶一路”建設提供保障的文件為分析對象

【摘要】:"貫徹機制"、"反思機制"以及"創(chuàng)制機制"是我國法院執(zhí)行公共政策的三大機制。我國法院執(zhí)行公共政策的過程,便是這三種機制之間互動的過程。同時,這三種機制共同反映了我國法院表達國家意志的"政治性"與執(zhí)行國家意志的"行政性",體現(xiàn)著我國法院在現(xiàn)實實踐中運作的政治邏輯根基。此外,這三種機制還承擔了將"政治問題"轉化為"法律問題"、將"法律問題"轉化為"程序性問題"和"技術性問題"的功能。這一方面體現(xiàn)了我國的司法運作受到了政治邏輯支配的現(xiàn)實,另一方面反映了我國的司法運作為政治運作賦予合法性的特點。這三種機制既保證了國家政治意志的貫徹執(zhí)行,又保證了司法運作的自治性、專業(yè)性與專屬性。
[Abstract]:"implementing mechanism", "introspection mechanism" and "creation mechanism" are the three major mechanisms for Chinese courts to carry out public policies. The process of implementing public policy by Chinese courts is the process of interaction between these three mechanisms. At the same time, these three mechanisms reflect the political nature of the state will expressed by the courts of our country and the "administrative nature" of the implementation of the national will together, and reflect the political logic foundation of the operation of the courts in the practical practice of our country. In addition, these three mechanisms have the functions of transforming "political issues" into "legal issues", and "legal issues" into "procedural issues" and "technical issues". On the one hand, this reflects the reality that the judicial operation of our country is dominated by political logic, on the other hand, it reflects the characteristic that the judicial operation of our country gives legitimacy to the political operation. These three mechanisms not only guarantee the implementation of national political will, but also guarantee the autonomy, professionalism and specificity of judicial operation.
