【摘要】：正司法責任制與辦案組織建設是當前檢察改革中比較受關注的話題。筆者就此談一些自己的看法。一、司法責任制與辦案組織建設中的五個矛盾當前檢察機關在司法責任制與辦案組織建設中,我認為主要有五個矛盾需要注意解決:一是辦案組負責制與承辦檢察官負責制的矛盾。我國檢察責任制改革,基本上采取兩種辦案組織形式:一種是獨任制,由承辦檢察官負責;另一種
[Abstract]:The judicial responsibility system and case-handling organization construction are the subject of concern in the current procuratorial reform. The author makes some comments on this. First, there are five contradictions between the judicial responsibility system and the construction of the case handling organization. At present, the procuratorial organs are in the process of the judicial responsibility system and the construction of the case handling organization. I think there are five contradictions that need to be solved: one is the contradiction between the responsibility system of case handling team and the responsibility system of undertaking procurator. The reform of procuratorial responsibility system in China basically adopts two forms of organization for handling cases: one is the sole appointment system, which is the responsibility of the procurators, and the other is the responsibility of the procurators.
