【摘要】：專業(yè)審判委員會作為人民法院審判委員會的重要組成部分,是人民法院審判組織的形式之一,是應(yīng)最高人民法院改革綱要的要求而設(shè)立的。與審判委員會一樣,專業(yè)審判委員會在總結(jié)審判經(jīng)驗(yàn)、討論重大或者疑難案件和其他審判工作等方面發(fā)揮著重要作用。最高人民法院在2007年和2010年分別印發(fā)了《關(guān)于改革和完善人民法院審判委員會制度的實(shí)施意見》,其中對專業(yè)審判委員會的設(shè)立提出了指導(dǎo)性意見。但隨著我國民主法治建設(shè)的發(fā)展和司法改革的深入推進(jìn),專業(yè)審判委員會在運(yùn)行過程中仍然在很大程度上受到審判委員會的影響,仍然存在審判委員會中存在的諸多問題,改革和完善這些問題也成為深化審判方式改革的需要。 本文通過對相關(guān)省市法院調(diào)研報告的研究,從專業(yè)審判委員會的建立、與審判委員會的關(guān)系以及專業(yè)審判委員會建立的原因等方面概述專業(yè)審判委員會的發(fā)展演進(jìn),并在對審判委員會的實(shí)施現(xiàn)狀和存在的人員組成及組織模式上的行政化、違背審判公開原則、直接、言辭審理原則、回避制度和錯案責(zé)任追究制度等方面的問題進(jìn)行分析的基礎(chǔ)上,從改革專業(yè)審判委員會的人員構(gòu)成、實(shí)行聽審制度、嚴(yán)格回避制度和錯案責(zé)任追究制度等方面入手,提出專業(yè)審判委員會進(jìn)一步改革和完善的建議和意見。
[Abstract]:As an important part of the people's court's trial committee, the professional judicial committee is one of the forms of the people's court's trial organization and was set up at the request of the reform outline of the Supreme people's Court. Like judicial committees, professional judicial committees play an important role in summing up trial experience, discussing major or difficult cases and other trial work. In 2007 and 2010, respectively, the Supreme people's Court issued opinions on the Reform and improvement of the Judicial Committee system of the people's Court. However, with the development of the construction of democracy and the rule of law in our country and the deepening of judicial reform, the professional judicial committees are still greatly influenced by the judicial committees in the course of operation, and there are still many problems existing in the judicial committees. Reform and perfect these problems also become the need of deepening the reform of trial method. Through the research on the investigation report of the relevant provincial and municipal courts, this paper summarizes the development and evolution of the professional judicial committee from the aspects of the establishment of the professional judicial committee, the relationship between the professional judicial committee and the judicial committee, and the reasons for the establishment of the professional judicial committee. And in the implementation of the status quo of the trial committee and the existing personnel composition and organizational model of the administrative, in violation of the principle of open trial, direct, verbal trial principle, On the basis of the analysis of the system of avoidance and the system of accountability for erroneous cases, and on the basis of the reform of the composition of the personnel of the professional judicial committee, the implementation of the system of hearing, the strict system of avoidance and the system of accountability for erroneous cases, and so on, Put forward the suggestion and opinion of further reform and consummation of professional judicial committee.
