【摘要】：人民調(diào)解制度是一項(xiàng)具有中國特色的糾紛解決制度。作為一種社會(huì)自治的糾紛解決機(jī)制,其核心在調(diào)解,強(qiáng)調(diào)的是一種合意的糾紛解決方式。這是人民調(diào)解制度與訴訟及其他非訴訟糾紛解決制度的區(qū)別所在,更是其合法性和正當(dāng)性的基礎(chǔ)和存在的意義。然而從人民調(diào)解制度的產(chǎn)生和發(fā)展的歷史來看,這項(xiàng)制度從產(chǎn)生時(shí)起就承載著深厚的政治功能,加上我國市民社會(huì)的不成熟和基層自治組織的自治性不足,人民調(diào)解制度的基礎(chǔ)性空間是由國家來推進(jìn)的,給人民調(diào)解機(jī)制的糾紛解決帶來強(qiáng)制的因素。 為理性地定位國家權(quán)力、人民調(diào)解組織和糾紛當(dāng)事人之間的關(guān)系,以嘗試尋求人民調(diào)解制度的完善與發(fā)展的路徑,本文通過對人民調(diào)解制度的概念、性質(zhì)、功能和特征的論述及其歷史的考察,對人民調(diào)解制度產(chǎn)生的機(jī)理進(jìn)行分析,并通過對現(xiàn)狀及其原因的評析,以尋求合意和強(qiáng)制兩者之間的平衡。全文除引言和結(jié)語外,共分為四個(gè)部分。第一部分主要從人民調(diào)解的概念、性質(zhì)、功能和特征入手,強(qiáng)調(diào)人民調(diào)解的群眾自治的性質(zhì)和糾紛解決的首要功能,并且通過與訴訟這一公力救濟(jì)方式相比較來分析人民調(diào)解所獨(dú)有的特征。第二部分主要對人民調(diào)解的歷史進(jìn)行梳理。從調(diào)解的歷史淵源到人民調(diào)解初創(chuàng)、確立和發(fā)展等這幾個(gè)前后相繼的階段,以及不同階段的不同特點(diǎn)進(jìn)行考察,為人民調(diào)解這一制度的產(chǎn)生機(jī)理的研究提供依據(jù)。第三部分則主要是對我國人民調(diào)解制度的現(xiàn)狀及原因進(jìn)行分析。通過對近年人民調(diào)解制度所獲得的成就總結(jié)人民調(diào)解新的發(fā)展,與此同時(shí)也對人民調(diào)解制度所遇到的問題以及造成問題的原因進(jìn)行剖析,為人民調(diào)解制度的進(jìn)一步完善提供基礎(chǔ)。第四部分主要是對人民調(diào)解制度的完善。結(jié)合我國的國情,從體現(xiàn)理念的較為宏觀的總體設(shè)想到更為詳細(xì)可供操作的具體制度為人民調(diào)解提供合理的建構(gòu)方案。 本文使用歷史調(diào)查、社會(huì)調(diào)查以及分析比較等研究方法,其價(jià)值在于嘗試從更為宏觀的角度對人民調(diào)解制度進(jìn)行考察和完善。
[Abstract]:The people's mediation system is a dispute settlement system with Chinese characteristics.As a kind of social autonomy dispute resolution mechanism, its core is mediation, which emphasizes a kind of consensual dispute resolution.This is the difference between the people's mediation system, litigation and other non-litigation dispute settlement systems, and the basis and significance of its legitimacy and legitimacy.However, judging from the history of the emergence and development of the people's mediation system, this system has carried a profound political function since its inception, coupled with the immaturity of our civil society and the lack of autonomy of grass-roots autonomous organizations.The basic space of the people's mediation system is promoted by the state, which brings compulsory factors to the dispute resolution of the people's mediation mechanism.In order to rationally locate the power of the state, the relationship between the people's mediation organization and the parties to the dispute, in order to try to find the path to the perfection and development of the people's mediation system, this paper discusses the concept and nature of the people's mediation system.This paper analyzes the mechanism of the people's mediation system through the analysis of the present situation and its causes in order to find the balance between the consensus and the compulsion.In addition to the introduction and conclusion, the full text is divided into four parts.The first part focuses on the concept, nature, function and characteristics of people's mediation, emphasizing the nature of mass autonomy and the primary function of dispute resolution.And analyze the unique characteristics of people's mediation by comparing it with litigation.The second part mainly combs the history of people's mediation.From the historical origin of mediation to the establishment, establishment and development of people's mediation, and the different characteristics of different stages, this paper provides a basis for the study of the mechanism of the system of people's mediation.The third part mainly analyzes the present situation and reasons of the people's mediation system in China.Through summing up the new development of the people's mediation through the achievements of the people's mediation system in recent years, at the same time, analyzing the problems encountered by the people's mediation system and the causes of the problems.To provide a basis for the further improvement of the people's mediation system.The fourth part is the perfection of the people's mediation system.According to the national conditions of our country, from the macroscopic overall assumption to the more detailed concrete system which can be operated, it provides a reasonable construction scheme for the people's mediation.This paper uses historical investigation, social investigation and analysis and comparison methods, its value lies in trying to investigate and perfect the people's mediation system from a more macroscopic angle.
