【摘要】：我國(guó)經(jīng)濟(jì)社會(huì)轉(zhuǎn)型速度加快,城鎮(zhèn)化率不斷提高,導(dǎo)致社會(huì)糾紛數(shù)量急劇增長(zhǎng),社會(huì)沖突亦在加劇。學(xué)術(shù)界和實(shí)踐界認(rèn)為調(diào)解是訴訟之外能夠有效化解社會(huì)糾紛的途徑之一。本文立足于張家灣司法所"五位一體"大調(diào)解模式的實(shí)踐,剖析大調(diào)解模式當(dāng)前存在的困境與問(wèn)題,認(rèn)為要從平臺(tái)、機(jī)制和制度等層面著手,規(guī)避或擺脫實(shí)踐困境,更好地發(fā)揮各個(gè)調(diào)解主體在大調(diào)解中的作用和功能。
[Abstract]:China's economic and social transformation accelerated urbanization rate continues to improve, leading to a sharp increase in the number of social disputes, social conflicts are intensified. The academic circle and the practice circle that mediation is one way of litigation can effectively resolve social disputes. Based on the practice of the "five in one" in the judicial mediation Zhangjiawan model, and analysis of the plight of the problem of mediation mode at present, think from the platform to mechanism and system level, to avoid or get rid of the plight of practice, and better play the function of each subject in the mediation mediation role.
