【摘要】：隨著互聯(lián)網(wǎng)技術(shù)的迅猛發(fā)展和廣泛應(yīng)用,網(wǎng)絡(luò)媒體成為繼報(bào)紙、廣播、電視等傳統(tǒng)媒體之后的第四媒體。依托于網(wǎng)絡(luò)媒體的天然優(yōu)勢(shì),網(wǎng)絡(luò)輿論監(jiān)督成為輿論監(jiān)督發(fā)展的新形式,其監(jiān)督范圍之廣,反應(yīng)之迅捷,主體之多元,均是傳統(tǒng)媒體所無(wú)法比擬的,在諸多熱點(diǎn)事件中的頻頻發(fā)力的網(wǎng)絡(luò)輿論監(jiān)督被看作是公民行使知情權(quán)、表達(dá)權(quán)、監(jiān)督權(quán)的至佳渠道,同時(shí)也被認(rèn)為是實(shí)現(xiàn)社會(huì)正義,推動(dòng)社會(huì)進(jìn)步的時(shí)代力量。司法是實(shí)現(xiàn)社會(huì)正義的另一股力量,進(jìn)入司法程序的案件往往對(duì)網(wǎng)絡(luò)輿論有著天然的吸引力,網(wǎng)絡(luò)輿論對(duì)司法的監(jiān)督有利于抑制司法腐敗,推動(dòng)司法改革,但同時(shí)也可能影響司法的獨(dú)立與公正。 隨著網(wǎng)絡(luò)輿論監(jiān)督的進(jìn)一步發(fā)展和深化,網(wǎng)絡(luò)輿論在對(duì)司法進(jìn)行監(jiān)督的過(guò)程中所暴露出來(lái)的一些問(wèn)題是無(wú)法忽視的,如何協(xié)調(diào)網(wǎng)絡(luò)輿論監(jiān)督與司法的關(guān)系成為亟待解決的問(wèn)題。本文從輿論監(jiān)督的發(fā)展歷程入手,并從發(fā)展階段、特點(diǎn)、現(xiàn)狀幾方面著重分析了網(wǎng)絡(luò)輿論對(duì)司法的監(jiān)督。論文主要通過(guò)理論分析和實(shí)證研究的方法,對(duì)網(wǎng)絡(luò)輿論監(jiān)督與司法的和諧與沖突關(guān)系進(jìn)行研究,分析沖突原因并對(duì)網(wǎng)絡(luò)輿論監(jiān)督與司法的和諧關(guān)系的構(gòu)建提出建設(shè)性意見(jiàn),以期二者在實(shí)現(xiàn)社會(huì)正義的共同目標(biāo)上達(dá)成一致。
[Abstract]:With the rapid development and wide application of Internet technology, Internet media has become the 4th media after the traditional media such as newspapers, radio, television and so on. Network public opinion supervision has become a new form of public opinion supervision. Its wide scope of supervision, rapid response and diversity of subjects are all unparalleled by traditional media. The network public opinion supervision, which frequently exerts power in many hot events, is regarded as the best channel for citizens to exercise their right to know, to express and to supervise, and also to realize social justice. Justice is another force to realize social justice. Cases that enter the judicial procedure often have natural attraction to network public opinion, and the supervision of justice by network public opinion is helpful to restrain judicial corruption. Promote judicial reform, but may also affect the independence and impartiality of the judiciary. With the further development and deepening of network public opinion supervision, some problems exposed by network public opinion in the process of judicial supervision cannot be ignored. How to coordinate the relationship between network public opinion supervision and judicature becomes an urgent problem to be solved. This paper mainly studies the harmonious and conflicting relationship between network public opinion and judicature by means of theoretical analysis and empirical research. This paper analyzes the causes of conflict and puts forward constructive suggestions on the construction of harmonious relationship between network public opinion supervision and judicature in order to achieve the common goal of social justice.
