【摘要】:在歐洲大陸,大學長久以來被當作法律教育的基地,承擔著絕大部分法律教育的任務(wù),但是這種觀念在英國并不適用。從中世紀晚期到近代早期,律師公會壟斷了英國的法律職業(yè)教育,成為培養(yǎng)法律從業(yè)者的主要場所,并藉此享有英國"第三所大學"的美譽。律師公會發(fā)展出一套獨特的學徒制教育模式,對英國15世紀中期至17世紀早期法律人才的培養(yǎng)居功至偉。本文由緒論、正文和結(jié)語三部分組成:緒論闡述本文選題緣由,梳理學界對近代以前律師公會的研究狀況,翻譯及界定本文所涉及的"律師公會"和"法律從業(yè)者"等基本概念。正文分為三個章節(jié)。第一章主要闡明律師公會興起的歷史背景以及四大律師公會和預(yù)備律師公會的概況。亨利二世的司法改革對普通法的產(chǎn)生和發(fā)展有重要影響,統(tǒng)一的中央司法機構(gòu)的確立則催生了英國中世紀法律職業(yè)階層。律師公會產(chǎn)生于14世紀初,但當時尚未具備對法律從業(yè)者的培養(yǎng)教育職能。第二章為本文重點。15世紀中期至17世紀前期是律師公會進行法律教育的成熟期,形成了學徒制的法律從業(yè)者培養(yǎng)模式。本章主要闡述律師公會的準入條件和人員構(gòu)成、法律教育模式和方法、"大學式"教育以及律師公會學徒的從業(yè)流向等四個方面。第三章采用比較法,在總結(jié)律師公會學徒制培養(yǎng)模式的主要特征及其后期衰落的基礎(chǔ)上,通過對比同時期英國牛津大學的"學院制"法律從業(yè)者培養(yǎng)模式,分析二者在教育內(nèi)容、培養(yǎng)目標等諸多方面的異同。結(jié)語總結(jié)全文,闡述筆者對15至17世紀英國法律從業(yè)者培養(yǎng)模式的認識以及本文對我國現(xiàn)代法律教育模式的借鑒意義。
[Abstract]:In continental Europe, universities have long been used as a base for legal education, undertaking most of the tasks of legal education, but this concept does not apply in England. From the late Middle Ages to the early modern times, The Law Society has monopolized the legal profession in the United Kingdom and become the main place for the training of legal practitioners, and thus enjoys the reputation of "the third university" in England. The Law Society has developed a unique model of apprenticeship education. This paper is composed of three parts: introduction, text and conclusion: the introduction explains the reason of choosing this topic, combs the research status of the law association before modern times. Translation and definition of the basic concepts of "Bar Association" and "Law Practitioners" in this paper. The text is divided into three chapters. The first chapter expounds the historical background of the Law Society's rise and the four bar associations and the law of preparation. An overview of the Hong Kong Teachers' Association. Henry II's judicial reform had an important impact on the emergence and development of the common law. The establishment of a unified central judiciary gave birth to the medieval English legal profession. The Bar Association was born in early 14th century. The second chapter focuses on the maturation period of the Law Society from the middle of the 15th century to the early 17th century. This chapter mainly expounds the admission conditions and personnel composition of the Bar Association. The mode and method of legal education, "university-style" education and the direction of the apprenticeship of the Bar Association. Chapter three adopts comparative method, on the basis of summing up the main characteristics of the apprenticeship training model of the Bar Association and its later decline. By comparing the training mode of "college system" legal practitioners in Oxford University of England in the same period, this paper analyzes the similarities and differences between them in many aspects, such as educational contents, training objectives and so on. This paper expounds the author's understanding of the training mode of British legal practitioners from 15 to 17th century and the significance of this paper to the modern legal education model in China.
