【摘要】：在實(shí)行法官員額制改革過程中,必須一并考慮法院審判人員的分類管理和優(yōu)化配置問題。在民事訴訟中,為保障公民的裁判請求權(quán),對于民事糾紛案件的審理,必須配置入額法官;對于非訟案件的審理、訴前或?qū)徢暗姆ㄔ赫{(diào)解以及立案登記等程序事項(xiàng)的處理應(yīng)交由司法實(shí)務(wù)官進(jìn)行,從而讓法官專注于民事糾紛案件的審判,以更好地落實(shí)公民的裁判請求權(quán)保障之憲法理念。司法事務(wù)官不同于助理審判員,其不能審理所有的民事案件;司法事務(wù)官也不同于法官助理,司法事務(wù)官不是法官的助手,其可以依法獨(dú)立行使職權(quán)。司法事務(wù)官不是憲法意義上的處理民事糾紛的法官,司法事務(wù)官不必進(jìn)入法官員額。
[Abstract]:In the process of carrying out the reform of judge post system, we must also consider the classified management and optimal allocation of court judges. In civil litigation, in order to protect citizens' right of claim, the trial of civil dispute cases must be taken into account. Must be staffed by an incoming judge; For the trial of non-contentious cases, the court mediation before or before the trial and the registration of the case should be handled by the judicial practice officer, so that the judge can focus on the trial of civil dispute cases. In order to better implement the constitutional concept of citizens' right to claim, judicial officers are different from assistant judges, they can not hear all civil cases; Judicial officers are also different from assistant judges. Judicial officers are not assistants to judges, and they can exercise their functions independently according to law. Judicial officers are not judges dealing with civil disputes in the sense of constitution. A judicial officer does not have to enter a judge's post.
