【摘要】：司法判決從本質(zhì)上可以抽象為一個三段論的過程,在這一過程中,適用法律做出合理判決的前提是生成三段論的小前提——裁判事實,也只有當事實得以正確、及時地確定,法官才能保障判決的質(zhì)量。但在司法實踐中,因為認定事實認定出現(xiàn)不確定而導(dǎo)致的冤假錯案屢見報端。其實,由于一些特定的原因,事實認定產(chǎn)生不確定性是客觀存在、難以消除的。所以,探究司法判決中事實認定的性質(zhì)并找出不確定性的成因是一個有意義的課題。本文對事實認定不確定性的核心問題進行了梳理和分析,除了前言和結(jié)語外,共分成三個部分： 第一章節(jié)是關(guān)于事實認定的內(nèi)涵。主要探討了司法判決中的事實、事實認定、事實認定的方法以及事實認定的不確定性等相關(guān)概念。依循事實進入訴訟程序直至最終認定的路徑,筆者將事實分成三個層面：糾紛事實、案件事實以及裁判事實,并根據(jù)事實認定的整體過程介紹了不同階段的一些認定方法,主要包括證據(jù)裁判原則、推理方法、經(jīng)驗法則等。最后,借由對不確定性概念的梳理討論,引出本文的核心概念——事實認定的不確定性。 第二章節(jié)是關(guān)于事實認定不確定原因的分析,也是本文的核心章節(jié)。筆者從三個視角對產(chǎn)生事實認定不確定性的原因進行了探討,分別包括了主體之視角、事實本身之視角以及司法程序之視角。從對這個視角下相關(guān)因素的分析,我們可以清晰的認識到事實認定不確定性存在的必然性。 第三章節(jié)是對事實認定不確定性的影響以及應(yīng)對方法的討論。事實認定是司法判決和核心問題,對其認定的不確定性肯定會對我國法治社會的建立和司法的公平正義產(chǎn)生消極影響。但事實認定的不確定性也是有限的,正因如此,我們可以從規(guī)則上去限制,從認識上去把握,從制度上去完善,去積極應(yīng)對不確定性的弊端,不斷實現(xiàn)司法的公正。
[Abstract]:Judicial decision can be abstracted as a process of syllogism in essence. In this process, the premise of applying law to make a reasonable judgment is to generate the small premise of syllogism-the fact of judgment, and only when the fact is correct. The judge can ensure the quality of the judgment in time. But in judicial practice, the false and wrong cases caused by the uncertainty of the fact are often seen in the newspaper. In fact, because of some specific reasons. The fact that the uncertainty is objective and difficult to eliminate. It is a meaningful subject to explore the nature of the fact finding and find out the cause of uncertainty in the judicial decision. This paper combs and analyzes the core issues of the uncertainty of fact determination, except the preface and conclusion. It is divided into three parts: The first chapter is about the connotation of fact determination. It mainly discusses the facts in the judicial decision and the fact determination. The author divides the facts into three levels: dispute facts. The facts of the case and the facts of the adjudication, and according to the whole process of the facts to identify the different stages of the introduction of some methods, including the principle of evidence adjudication, reasoning methods, rules of experience and so on. Finally. By combing and discussing the concept of uncertainty, this paper leads to the core concept of uncertainty of fact. The second chapter is the analysis of the reasons for the uncertainty of facts, which is also the core chapter of this paper. The author discusses the reasons for the uncertainty of the facts from three perspectives, including the perspective of the subject. From the angle of view of the fact itself and the judicial procedure, we can clearly realize the inevitability of the fact that the uncertainty exists from the analysis of the relevant factors under this perspective. The third chapter is the impact of the uncertainty of the facts and how to deal with them. The fact determination is the judicial decision and the core issue. The uncertainty of its determination will definitely have a negative impact on the establishment of a society ruled by law and the fairness and justice of justice. However, the uncertainty of fact determination is also limited, which is why we can limit it from the rules. Grasp from the understanding, from the system to perfect, to actively deal with the drawbacks of uncertainty, constantly realize justice.
