【摘要】：行政規(guī)劃也稱為行政計(jì)劃,是行政多元化和管理方式革新以后新型行政行為的重要組成部分,也是現(xiàn)代行政管理的常用手段和方式。我國(guó)雖實(shí)行計(jì)劃經(jīng)濟(jì)多年,但對(duì)行政規(guī)劃研究并不深入,對(duì)行政規(guī)劃概念的討論也不多見(jiàn)。2000年以來(lái),越來(lái)越多的學(xué)者開(kāi)始關(guān)注行政規(guī)劃,但就總體而言,對(duì)行政規(guī)劃的研究的法律程度仍有待加強(qiáng)。 司法審查是保護(hù)行政規(guī)劃相對(duì)人權(quán)益最為主要和有效的途徑,也是保證相對(duì)人的最后一道防線,對(duì)行政規(guī)劃的司法審查制度研究,具有重要意義。研究這個(gè)課題可以說(shuō)就是為了保障行政相對(duì)人,在行政規(guī)劃行為造成行政相對(duì)人權(quán)益損害,行政相對(duì)人可以找到途徑來(lái)維護(hù)自己的權(quán)益,所謂有權(quán)利必有救濟(jì),將行政規(guī)劃納入司法審查范圍勢(shì)在必行。 本文參考德國(guó)和日本兩個(gè)在行政規(guī)劃方面做的較好的國(guó)家的理論和實(shí)踐,在行政規(guī)劃的司法審查方面提出對(duì)現(xiàn)狀的意見(jiàn)和對(duì)改革的設(shè)想。
[Abstract]:Administrative planning is also known as the administrative plan is an important part of administrative management and diversified after the reform of new administrative behavior, is also commonly used in modern administrative management means and methods. Although China's planned economy for many years, but the study of administrative planning is not thorough, since the discussion of administrative planning concept also does not see more.2000 years. More and more scholars begin to pay attention to the administrative planning, but overall, the law degree of the administrative planning is still to be strengthened.
The judicial review is to protect the rights and interests of the relative people of administrative planning are the most important and effective way, but also to ensure that the last line of defense of the research on the judicial review system of administrative planning, which is of great significance. This research can be said that in order to protect the administrative relative person, causing damage to the interests of the administrative relative person in administrative planning, administrative people can find ways to protect their own interests, the right there is a remedy, will be included in the scope of judicial review of administrative planning is imperative.
Referring to the two theories and practices of Germany and Japan, which are doing better in administrative planning, this paper puts forward the opinions on the current situation in the judicial review of administrative planning and the assumption of reform.
