檢察官辦案責任制改革探索

【摘要】:20世紀初期我國曾經進行過主訴檢察官辦案責任制改革。黨的十八大之后,檢察官辦案責任制改革再次成為司法改革的重要內容。兩次改革均未達到預期目的,究其原因是為我國政策實施型司法模式所限制。政策實施型司法與科層體制具有高度的契合性。而行政審批制辦案模式則滿足了政策實施型司法權力集中與質量控制方面的需要。因此,兩次改革都不可能從根本上放棄行政審批制辦案模式。面對辦案責任的壓力,我國檢察官辦案責任制改革則通過部分權力讓渡與責任范圍劃分的方式予以化解,但這均非根本的解決之道。未來的檢察官辦案責任制改革需要在轉變政策實施型司法模式的基礎上,疏離政策實施型司法與行政審批制之間的緊密關系,構建起檢察一體與檢察官獨立相協調的辦案機制。
[Abstract]:In the beginning of 20th century, China once carried out the reform of the responsibility system for handling cases of chief prosecution prosecutors. The reason is that it is limited by the policy enforcement judicial model in our country. The need for control. In the face of the pressure of the responsibility of handling cases, the reform of the responsibility system of procurators handling cases in our country is resolved by means of part of the transfer of power and division of the scope of responsibility. But this is not the fundamental solution. In the future, the reform of the procurator case responsibility system needs to shift the policy implementation of the judicial model, alienate the close relationship between the policy implementation of the judiciary and the administrative examination and approval system. Build a procuratorial body and prosecutors independent coordination of the handling of cases mechanism.
