鑒于證人證言在刑事案件審理中的重要性,本文試圖研究警察詢問階段證人語言的特點,著重于其中銜接手段的使用。證人借助于銜接手段的使用,使證詞具有更強的一致性、相關(guān)性、邏輯性等,因而提高證詞的可信度。 本文擬從關(guān)聯(lián)理論的角度出發(fā),根據(jù)關(guān)聯(lián)假設(shè)及關(guān)聯(lián)原則來分析銜接手段在證人語言中的選擇與使用。詢問作為證人與警察之間的一種交際是一個明示—推理過程。從證人角度來說是一種明示過程,而根據(jù)關(guān)聯(lián)原則,每一個明示的交際行為應(yīng)設(shè)想為本身具有最佳關(guān)聯(lián)性,即同等條件下語境效果越大,付出的努力越小,關(guān)聯(lián)性就越強。在明示過程中證人借助于明示刺激—銜接手段的使用以達(dá)到此目的。 根據(jù)從法院收集的警察詢問筆錄及本文構(gòu)建的理論框架,主要解決兩個問題:1.證人在證言中是如何選擇使用不同的銜接手段以及在這一特定的語境下銜接手段的特點。2.他們?nèi)绾瓮ㄟ^運用這些銜接手段來增強證言的可信度。通過對這兩個問題的分析,我們可以得出這樣的結(jié)論:關(guān)聯(lián)理論可以解釋證人語言中銜接手段的選擇與使用。因為本文研究的對象是證人語言,因而著重的是從證人角度來探討明示這一過程。至于他們有意運用的這些語言策略是否達(dá)到他們意想的效果,是否有助于減...
