【摘要】：為適應(yīng)全球金融商品和投資服務(wù)不斷創(chuàng)新發(fā)展的現(xiàn)實需要,近年來,諸多國家的金融法制出現(xiàn)了從縱向金融行業(yè)規(guī)制向橫向金融商品規(guī)制的發(fā)展趨勢。其中,日本的《金融商品交易法》在"有價證券"的范圍中導(dǎo)入"集合投資計劃"概念以規(guī)制各類投資基金的情形頗受關(guān)注。在我國《證券投資基金法》修訂之際,從全面保護投資者的角度出發(fā),日本對集合投資計劃從組成到運營進行橫向覆蓋的制度規(guī)范經(jīng)驗堪值借鑒。
[Abstract]:In order to meet the real needs of the continuous innovation and development of global financial commodities and investment services, in recent years, the financial legal system of many countries has developed the trend of regulation to the lateral financial commodity from the longitudinal financial industry. Among them, Japan's Financial Commodity Exchange Law> The concept of "Import Collection Investment Plan" in the scope of "securities" to regulate the situation of various investment funds is of great concern. At the time of the revision of China's Securities Investment Fund Law, from the perspective of the comprehensive protection of the investors, Japan's experience in the system of the cross-covering of the aggregate investment plan from the composition to the operation can be used for reference.
