【摘要】：2010年,美國(guó)國(guó)會(huì)圖書館頒布了6種規(guī)避技術(shù)措施例外情形,例外情形之一為規(guī)避DVD技術(shù)措施例外。規(guī)避DVD技術(shù)措施例外使社會(huì)公眾可以基于評(píng)論、教育、拍攝記錄影片、制作非營(yíng)利影視作品的目的規(guī)避DVD影片上的技術(shù)措施。但是,該項(xiàng)例外適用條件嚴(yán)格,適用范圍狹窄,無法妥善解決DVD影片使用上著作權(quán)人和社會(huì)公眾之間的矛盾。我國(guó)著作權(quán)法中有關(guān)技術(shù)措施的立法應(yīng)吸取美國(guó)國(guó)會(huì)圖書館的經(jīng)驗(yàn)與教訓(xùn),完善技術(shù)措施例外類型,確定合適的例外情形適用范圍,確保技術(shù)措施例外規(guī)定發(fā)揮其應(yīng)有功效。
[Abstract]:In 2010, the Library of Congress promulgated six exceptions to circumvent technical measures, one of which was to circumvent DVD technical measures. The exception of circumventing DVD technical measures enables the public to circumvent the technical measures of DVD films based on the purpose of commenting, educating, shooting and recording films and making non-profit film and television works. However, the application conditions of this exception are strict and the scope of application is narrow, which can not properly solve the contradiction between copyright owners and the public in the use of DVD films. The legislation of technical measures in copyright law of our country should draw lessons from the experience and lessons of the Library of Congress of the United States, perfect the types of exceptions to technical measures, determine the applicable scope of appropriate exceptions, and ensure that the exceptions of technical measures play their due role.
