論沈家本的良善刑法觀

【摘要】：作為一個博古通今、學貫中西的晚清法學大家,沈家本認為"各法之中,尤以刑法為切要",刑法應當是良善之法,既要穩(wěn)定、統(tǒng)一、明確,又要權時而變,保障人權及平等,并闡述了良善刑法的產(chǎn)生及實現(xiàn)條件,這些對于當今我國正在進行的刑事立法及司法改革仍具有十分重要的借鑒意義。
[Abstract]:As a scholar of the late Qing Law of China and the West, Shen Jiaben believed that "among all laws, criminal law is the most important." the criminal law should be a law of good and good. It should be stable, unified, clear, and change from time to time in order to safeguard human rights and equality. It also expounds the emergence and realization conditions of good criminal law, which is still of great significance for the criminal legislation and judicial reform in our country.
