【摘要】：從"南京強(qiáng)泉運(yùn)輸貿(mào)易有限公司訴太平財(cái)產(chǎn)保險(xiǎn)有限公司福建分公司"案入手,對(duì)八級(jí)風(fēng)問(wèn)題的由來(lái)、認(rèn)定方法、與事故是否存在因果關(guān)系逐一梳理,在此基礎(chǔ)上,總結(jié)概括出目前認(rèn)定船舶是否遭遇到八級(jí)以上風(fēng)并因此導(dǎo)致事故發(fā)生時(shí)應(yīng)當(dāng)選擇的思路和方法。
[Abstract]:Starting from the case of Nanjing Qiangquan Transportation Trade Co., Ltd. v. Fujian Branch of Taiping property Insurance Co., Ltd., the origin of the eighth grade wind problem, the determination method and the causality of the accident are combed one by one. On this basis, This paper summarizes the ideas and methods that should be chosen to determine whether the ship has been subjected to the wind of grade 8 or above and thus to cause the accident.
