【摘要】：正作為一門與司法實(shí)踐緊密聯(lián)系的學(xué)科,法學(xué)與其他人文學(xué)科有較大的區(qū)別。法學(xué)教育不僅要傳授法學(xué)知識(shí),而且還要擔(dān)負(fù)起培養(yǎng)掌握各類法律技能,勝任實(shí)際法律工作的"法律人"的重任。由此觀之,"實(shí)踐性"、"應(yīng)用性"成為當(dāng)前大陸法學(xué)教育的一個(gè)導(dǎo)向,可謂是順應(yīng)了法學(xué)教育的內(nèi)在規(guī)律。為了培養(yǎng)法科學(xué)生的法律實(shí)務(wù)能力,就需要強(qiáng)化法學(xué)院的實(shí)踐性教學(xué)。法學(xué)實(shí)踐性教學(xué)的內(nèi)容廣泛,并且處于不斷的發(fā)展、變化當(dāng)中;不過,案例教學(xué)在其中始終居于某種關(guān)鍵地位�？v觀當(dāng)今世界,影響較大的案例教學(xué)模式主要是以美國(guó)為代表的"個(gè)案教學(xué)法"、以德國(guó)為代表的"實(shí)例研習(xí)",以及起源
[Abstract]:As a subject closely related to judicial practice, law is different from other humanities. Legal education should not only impart legal knowledge, but also take on the important task of cultivating "legal person" who can master all kinds of legal skills and be competent in practical legal work. From this point of view, "practicality" and "application" have become a guide of current law education in mainland China, which can be said to conform to the inherent law of law education. In order to cultivate the legal practice ability of law science students, it is necessary to strengthen the practical teaching in law school. The content of practical teaching of law is extensive, and it is constantly developing and changing; however, case teaching has always played a key role in it. Throughout the world, the most influential case teaching models are mainly the case teaching method represented by the United States, the case study represented by Germany, and the origin of the case teaching method.
