【摘要】：女性問題的跨意識(shí)形態(tài)性、我國(guó)法律現(xiàn)代化進(jìn)程的不可逆性與女性主義法學(xué)本身的批判性和進(jìn)步性,決定了在我國(guó)開啟以"性別與法律"為主旨的女性主義法學(xué)研究的重要理論和實(shí)踐價(jià)值。目前,我國(guó)在研究的學(xué)科類別上,已形成法理學(xué)為主導(dǎo),部門法共同參與的局面;在研究基地和社會(huì)影響上,已形成以中國(guó)社科院法學(xué)所為重鎮(zhèn),各地高校與研究機(jī)構(gòu)積極參與和推動(dòng)的格局;在研究問題上,已在認(rèn)識(shí)論和法律事實(shí)兩個(gè)層面形成多樣議題。但是,法學(xué)認(rèn)識(shí)論層面的研究不足、女性主義法學(xué)研究的邊緣化、研究者尚未形成統(tǒng)一的研究立場(chǎng)和研究隊(duì)伍學(xué)科背景單一等問題也掣肘著女性主義法學(xué)的發(fā)展。法學(xué)研究者需通過不斷拓展法學(xué)認(rèn)識(shí)論研究,積極結(jié)合中國(guó)現(xiàn)實(shí)吸納新知、超越意識(shí)形態(tài)客觀審視西方社會(huì)理論,加強(qiáng)與其他學(xué)科的合作等方式,共同推動(dòng)我國(guó)女性主義法學(xué)研究的發(fā)展。
[Abstract]:The cross-ideological nature of women's issues, the irreversibility of the legal modernization process in China and the critical and progressive nature of feminist jurisprudence itself, It determines the important theoretical and practical value of the feminist legal research in China. At present, China has formed a situation in which jurisprudence is the leading subject category and departments participate in the field of law, and in terms of research base and social impact, it has formed a major town in the field of law of the Chinese Academy of Social Sciences. The pattern of active participation and promotion of universities and research institutions in various places has formed various topics on the aspect of epistemology and legal facts. However, the lack of research on the epistemology of law, the marginalization of feminist jurisprudence, the lack of a unified research position and the single disciplinary background of the research team have also hindered the development of feminist jurisprudence. Legal researchers should constantly expand the study of legal epistemology, actively combine with Chinese reality to absorb new knowledge, transcend ideology to examine western social theories objectively, and strengthen cooperation with other disciplines. Jointly promote the development of feminist legal research in China.
