【摘要】： 作為本文研究對象的“田宅典契”是指契約實質(zhì)內(nèi)容反映正典法律關(guān)系的一類契約。這類契約名稱多樣,形式相對穩(wěn)定,完全符合典制轉(zhuǎn)讓典業(yè)占有、使用、收益的權(quán)利,獲得典價,并可以回贖的性質(zhì)。典契與反映借貸擔(dān)保性質(zhì)的抵押類契約、動產(chǎn)質(zhì)押的當(dāng)票有著根本的不同。為了完成對“典契”這一中國特有現(xiàn)象的初步研究,本文首先對典制產(chǎn)生后各個時期的典制法律規(guī)范和契約文本進行簡要闡述,重點地對清代典制相關(guān)法律和典契文本進行了分析梳理,希望從實質(zhì)和形式上均能描繪出清代田宅典契的概貌。本文通過對清代以前的田宅典制法律規(guī)范及契約文本進行簡要梳理,發(fā)現(xiàn)典契于發(fā)展時期即已形成較為穩(wěn)定的形式,達到了一定的成熟度,后世典契是在其基礎(chǔ)上的進一步完善。 本文將清代典制法律規(guī)范分為五方面進行闡述,即典的概念、典期、風(fēng)險負擔(dān)和房屋修繕、契稅和相關(guān)雙方權(quán)利義務(wù)五個部分。從中可以看出國家法律對田宅典當(dāng)一類民間細故的規(guī)范持寬松態(tài)度,立契人訂立契約時可以根據(jù)民間習(xí)慣進行約定。本文重點對清代田宅典契文本進行考察,從形式、典業(yè)種類、標(biāo)的等方面對其進行分類,并且將文本信息統(tǒng)一歸納總結(jié),概括出契約文本所顯示的立契雙方權(quán)利義務(wù)、典期及違約責(zé)任等主要內(nèi)容。最后,對與清代田宅典契有關(guān)問題進行探討,包括親鄰優(yōu)先權(quán)、契約中的受典人權(quán)利義務(wù)保障機制、重復(fù)朦朧典賣、出典人租回出典土地、當(dāng)契及賦稅交割的問題,以期更全面地反映其原貌。
[Abstract]:As the object of this paper, the title deed refers to a kind of contract which reflects the legal relationship of canon. This kind of contract has various names and relatively stable forms, which fully accords with the rights of possession, use and income of the canonical transfer, obtains the price of the code, and can be redeemed. The title deed is fundamentally different from the mortgage contract which reflects the nature of loan guarantee. In order to complete the preliminary study on the "Code contract", this paper first briefly expounds the legal norms and contract texts of the canonical system in each period after the establishment of the Code system. This paper analyzes and combs the relevant laws and documents of the Qing Dynasty, hoping to describe the outline of the land and house title in the Qing Dynasty in essence and form. Through a brief analysis of the legal norms and contract texts of the farmland house system before the Qing Dynasty, it is found that the classical contract has formed a relatively stable form in the period of development, and has reached a certain degree of maturity. The ancient deed of later generations is further consummated on its basis. In this paper, the legal norms of the Qing Dynasty canonical system are divided into five parts, namely, the concept of the Code, the period of the Code, the burden of risk and the repair of houses, the deed tax and the rights and obligations of the related parties. From this, we can see that the state law has a loose attitude towards the fine folk norms of farmland and house pawning, and can be agreed upon according to the folk custom when the initiator enters into a contract. This paper focuses on the study of the text of the title deed of Tian House in Qing Dynasty, classifies it from the aspects of form, type and target, and generalizes the information of the text, and generalizes the rights and obligations of the parties to the contract, which are shown in the text of the contract. Typical period and breach of contract liability and other main content. Finally, the paper discusses the issues related to the title deeds of farmland and houses in the Qing Dynasty, including the priority of the neighboring countries, the protection mechanism of the rights and obligations of the code recipients in the contract, the repeated sale of obscure classics, the rentals of the land by the couriers, the settlement of the deeds and the payment of taxes.
