【摘要】： 法律接受是指社會(huì)公眾對(duì)法律規(guī)范的接納、認(rèn)同、內(nèi)化、服從或蔑視、違背、規(guī)避和抗拒等行為反映。本文認(rèn)為法律接受生存于個(gè)人、國(guó)家、社會(huì)三者共同構(gòu)成的系統(tǒng)之中,對(duì)法律的理解、認(rèn)同和對(duì)法律接受的動(dòng)因分析是構(gòu)成法律接受的社會(huì)心理機(jī)制必不可少的兩個(gè)部分。但僅僅是這樣,并不能形成相應(yīng)的社會(huì)心理機(jī)制,所以還需要從社會(huì)互動(dòng)的角度來(lái)探析如何形成這一社會(huì)心理機(jī)制。具體而言,文章包括了五個(gè)方面的內(nèi)容:第一章是對(duì)現(xiàn)有研究成果進(jìn)行大致的梳理,進(jìn)而尋找其中的空白點(diǎn),以此為突破口提出文章的論點(diǎn)和結(jié)構(gòu)安排;第二章研究法律接受的空間,法律接受是在個(gè)人、國(guó)家、社會(huì)的三維空間里成長(zhǎng),進(jìn)而形成相應(yīng)的機(jī)制;第三章分析法律認(rèn)同過(guò)程中法律的正當(dāng)性和法律符號(hào)與法律接受的關(guān)系。這一部分作為法律接受的社會(huì)心理機(jī)制的重要內(nèi)容,旨在理清關(guān)系的基礎(chǔ)上分析個(gè)體、社會(huì)對(duì)法律的態(tài)度;第四章分析法律接受的社會(huì)動(dòng)因,社會(huì)動(dòng)機(jī)是法律接受行為的基礎(chǔ),而社會(huì)力量推動(dòng)法律接受向社會(huì)預(yù)期的方向進(jìn)行,二者共同作用,達(dá)成法律接受的社會(huì)效果;第五章著重分析以社會(huì)互動(dòng)的方式表現(xiàn)的法律接受。 我國(guó)要建立社會(huì)主義法治國(guó)家,則必須要建立一個(gè)良好的社會(huì)心理環(huán)境,提高社會(huì)對(duì)法律的認(rèn)同與接納。法律接受的社會(huì)心理機(jī)制是將社會(huì)心理學(xué)的方法運(yùn)用于法律接受的各個(gè)進(jìn)程。只有在對(duì)法律接受的社會(huì)心理機(jī)制有一定的了解之后才能形成有機(jī)互動(dòng),達(dá)成正向的法律接受,完善社會(huì)法治。
[Abstract]:Legal acceptance refers to the acceptance, internalization, obedience or contempt, violation, circumvention and resistance of legal norms by the public. This paper holds that legal acceptance exists in the system composed of individual, state and society. The understanding of law, the identification of law and the analysis of the motivation of legal acceptance are two indispensable parts of the social psychological mechanism of legal acceptance. But just like this, can not form the corresponding social psychological mechanism, so we still need to explore how to form this social psychological mechanism from the angle of social interaction. Specifically, the article includes five aspects: the first chapter is to sort out the existing research results, and then to find the gaps, as a breakthrough point to put forward the argument and structure of the article; The second chapter studies the space of legal acceptance, which grows in the three dimensional space of individual, country and society, and then forms the corresponding mechanism. The third chapter analyzes the legitimacy of law and the relationship between legal symbols and legal acceptance. This part, as an important part of the social psychological mechanism of legal acceptance, aims to analyze the individual and social attitude to the law on the basis of clarifying the relationship, the fourth chapter analyzes the social motivation of legal acceptance, which is the basis of legal acceptance. The social forces promote the legal acceptance to the direction expected by the society, and the two act together to achieve the social effect of legal acceptance; the fifth chapter focuses on the analysis of the legal acceptance expressed in the way of social interaction. In order to establish a socialist country ruled by law, we must establish a good social psychological environment and enhance the social acceptance of the law. The social psychological mechanism of legal acceptance is to apply the method of social psychology to each process of legal acceptance. Only when we have a certain understanding of the social psychological mechanism of legal acceptance can we form an organic interaction to achieve positive legal acceptance and perfect the social rule of law.
