【摘要】： 信訪制度是一項(xiàng)具有中國(guó)特色的政治法律制度,它在發(fā)揮積極作用的同時(shí)也產(chǎn)生了許多現(xiàn)實(shí)問(wèn)題。分析信訪制度存在的問(wèn)題,探尋有效解決信訪問(wèn)題的路徑,這在當(dāng)今推動(dòng)我國(guó)依法治國(guó)、構(gòu)建和諧社會(huì)具有重要意義。 本文認(rèn)為解決當(dāng)今信訪制度存在的問(wèn)題,就是將信訪納入法治的軌道,實(shí)現(xiàn)信訪法治化。 首先,對(duì)信訪制度基本理論先予以概述。在闡釋信訪基本概念基礎(chǔ)上,指出下文很多論證和分析僅僅選取《信訪條例》和行政信訪為著眼點(diǎn),但這不影響文章的思考主題仍是立足于廣義的信訪制度。并指出信訪制度既是一種補(bǔ)充救濟(jì)制度也是一項(xiàng)民主政治制度。著重對(duì)信訪制度的功能和當(dāng)前信訪制度的安排介紹分析。 其次,分析我國(guó)信訪制度存在的問(wèn)題。從一組調(diào)查統(tǒng)計(jì)數(shù)字分析出當(dāng)前信訪面臨困境,反映出信訪制度存在問(wèn)題。一是信訪制度功能定位不準(zhǔn)確；二是立法存在缺陷；三是執(zhí)法過(guò)程存在問(wèn)題。指出信訪制度缺失造成的負(fù)面影響,因此,需要對(duì)信訪制度進(jìn)行改革完善,將信訪納入法治的軌道,實(shí)現(xiàn)信訪法治化。 最后,對(duì)行政信訪制度完善方向提出了合理化建議。介紹了瑞典、英國(guó)、法國(guó)等國(guó)外行政監(jiān)察專員制度,在借鑒其成功經(jīng)驗(yàn)的基礎(chǔ)上提出我國(guó)信訪制度的完善建議。一是要正確定位信訪功能；二是針對(duì)立法缺陷和執(zhí)法不力的問(wèn)題,提出相應(yīng)的解決辦法,如制定我國(guó)的信訪法,設(shè)置信訪機(jī)構(gòu)及其體系,完善信訪程序設(shè)置,加強(qiáng)責(zé)任追究等；三是加強(qiáng)信訪制度外部法律、政治環(huán)境的協(xié)調(diào)。
[Abstract]:The petition system is a political and legal system with Chinese characteristics. It is of great significance to analyze the problems existing in the system of letters and visits and to explore the ways to solve them effectively, which is of great significance in promoting the rule of law and building a harmonious society in our country. In this paper, the author thinks that to solve the problems existing in the system of letters and visits, it is to bring them into the orbit of rule of law and to realize the legalization of letters and visits. First of all, the basic theory of petition system is first summarized. On the basis of explaining the basic concept of letters and visits, it is pointed out that many of the following argumentation and analysis only select the "letter and visit regulations" and administrative letters and visits as the starting point, but this does not affect the thinking theme of the article is still based on the broad system of letters and visits. It also points out that the petition system is not only a supplementary relief system but also a democratic political system. This paper mainly introduces and analyzes the function of petition system and the arrangement of current petition system. Secondly, it analyzes the problems existing in the system of letters and visits in China. From a group of investigation statistics, this paper analyzes the predicament of the present petition system, which reflects the problems existing in the letter and visit system. First, the function of petition system is inaccurate; second, there are defects in legislation; and third, there are problems in the process of law enforcement. This paper points out the negative influence caused by the absence of petition system, so it is necessary to reform and perfect the petition system, bring it into the orbit of rule of law, and realize the legalization of petition and petition. Finally, some reasonable suggestions are put forward to perfect the system of administrative letters and visits. This paper introduces the administrative supervisory system of Sweden, Britain, France and other foreign countries, and puts forward some suggestions to perfect the system of letters and visits in our country on the basis of its successful experience. The first is to correctly locate the function of letter and visit, the other is to put forward the corresponding solutions in view of the defects of legislation and the weak enforcement of the law, such as formulating the law of petition and visiting in our country, setting up the petition organization and its system, perfecting the setting of the procedure of petition and visiting, strengthening the investigation of responsibility, etc. Third, strengthen the coordination of external law and political environment of petition system.
