【摘要】：將可行能力作為區(qū)分弱勢群體的標準可以包容多維信息內容,該標準作為平等保護原則的運用可為弱勢群體的特殊保護措施提供正當性依據(jù)。中國法律體系中存在的阻礙實現(xiàn)司法救濟權的可行能力的因素包括司法救濟權在法律中的缺位、實體權利配套保障措施的缺位、起訴條件的嚴格限制、訴訟相關費用的高昂以及法律援助制度的不完備等,針對這些障礙應通過在憲法中明確規(guī)定司法救濟權、改革訴訟費用和律師費用以及完善法律援助制度的構建等措施進行改善。
[Abstract]:Taking the feasible ability as the criterion to distinguish the vulnerable groups can contain multi-dimensional information content, and the application of this standard as the principle of equal protection can provide the legitimate basis for the special protection measures of the vulnerable groups. The factors that hinder the feasible ability to realize the right of judicial remedy in China's legal system include the absence of the right to judicial remedy in the law, the absence of supporting measures for the protection of substantive rights, and the strict limitation of the conditions for prosecution. The high costs associated with litigation and the inadequacy of the legal aid system should be addressed by explicitly establishing the right to judicial redress in the Constitution, Reform litigation fees and lawyers' fees and improve the construction of legal aid system.
