【摘要】： 依法治國,建設社會主義法治國家,已經(jīng)成為全社會的共識。在中國的法治化進程中,我們必須立足國情。我國是一個多民族的國家,并且是一個以農(nóng)村為主的社會,這就必然會存在一些根深蒂固的民間的風俗習慣,而這些習慣也正是維持本民族或本村落的秩序,要想在很短的時間內(nèi)來消除它,完全用國家法來維持,那必然會引起沖突。在寫本文時,筆者從三個大的方面來進行論述的。首先,本文在界定“活法”“死法”概念的基礎上,闡述了它們的特征與淵源,以及它們的積極性與消極性,其次,論述了它們的沖突與互補關系,最后,在分析了當代法治的價值趨向的基礎上,闡述了中國法治之路的走向問題,以及二者的互補對當代中國法治之路的構建的影響。本文的最大創(chuàng)新點就是把“死法”與“活法”結合起來進行論述的,以及它門對中國法治之路構建的影響。同時,應有效的加強馬克思主義法學理論,進一步處理好二者的關系,推進中國的法治之路進程的構建。
[Abstract]:Ruling the country according to law and building a socialist country ruled by law has become the consensus of the whole society. In the process of rule of law in China, we must base ourselves on our national conditions. Our country is a multi-ethnic country and a predominantly rural society, which will inevitably lead to the existence of some deep-rooted folk customs and habits that maintain the order of our own people or villages. To eliminate it in a short period of time, to maintain it entirely by national law, it will inevitably lead to conflict. In writing this article, the author from three major aspects to discuss. First of all, on the basis of defining the concept of "living method" and "death method", this paper expounds their characteristics and origin, their enthusiasm and negativity, secondly, discusses their conflict and complementary relations, finally, Based on the analysis of the value trend of the contemporary rule of law, this paper expounds the trend of the road of the rule of law in China, and the influence of the complementarity of the two on the construction of the road of the rule of law in contemporary China. The greatest innovation of this paper is to discuss the combination of "death method" and "living method" and its influence on the construction of China's rule of law. At the same time, we should effectively strengthen the Marxist legal theory, further deal with the relationship between the two, and promote the construction of the road of rule of law in China.
