【摘要】： 典當(dāng)行是我國一種古老的商業(yè)機(jī)構(gòu)、金融機(jī)構(gòu),至近代民國已經(jīng)有數(shù)千年的歷史,解放后由于其高利剝削的名聲,被政府陸續(xù)取締,然而八十年代以來,典當(dāng)行在我國又重新興起,并呈現(xiàn)出欣欣向榮的景象。民國時(shí)期,上海為當(dāng)時(shí)的經(jīng)濟(jì)、金融中心,典當(dāng)行以及典當(dāng)性質(zhì)的押店非常發(fā)達(dá),典當(dāng)法制亦非常健全,本文旨在研究民國上海地區(qū)的典當(dāng)法律、法規(guī)及行業(yè)習(xí)慣,回顧這段典當(dāng)史中的法制,并提出法理思考。本文共分四個(gè)部分,第一章概述典當(dāng)?shù)幕痉蓡栴},澄清典當(dāng)一詞在不同語境下的法律涵義,同時(shí)簡單回顧我國古代典當(dāng)法制、民國上海典當(dāng)行、押店的制度史。第二章民國上海典當(dāng)法律關(guān)系構(gòu)成,從主體、客體的角度,分類研究典當(dāng)行、押店的設(shè)立、公益典當(dāng)以及當(dāng)物等問題。第三章民國上海典當(dāng)權(quán)利義務(wù)規(guī)范,把民國上海典當(dāng)法律規(guī)范分為權(quán)利規(guī)范和義務(wù)規(guī)范,分別闡釋典當(dāng)行、押店的權(quán)利和義務(wù)。第四章民國典當(dāng)法律的啟示,首先回顧當(dāng)代我國典當(dāng)立法的現(xiàn)狀,其次提出對(duì)典當(dāng)?shù)姆ɡ硭伎肌?br/>[Abstract]:Pawnshop is an ancient commercial organization and financial institution in our country. It has a history of thousands of years since the Republic of China. After liberation, it was banned by the government because of its reputation of high-profit exploitation. However, since the 1980s, Pawnbroking shop in our country again rise, and present the scene of prosperity. During the period of the Republic of China, Shanghai was the economic, financial center, pawnshop and pawnbroker, and the law of pawn was very perfect. This paper aims to study the pawn laws, regulations and trade habits in the Republic of China. Review the legal system in the pawn history, and put forward the legal thinking. This paper is divided into four parts. The first chapter summarizes the basic legal problems of pawn, clarifies the legal meaning of the word pawn in different contexts, and briefly reviews the institutional history of the ancient pawn law, the pawnshop of the Republic of China and the pawnshop in Shanghai. The second chapter is the composition of the legal relationship of pawnshop in Shanghai of the Republic of China. From the angle of subject and object, this chapter classifies the pawnshop, the establishment of pawnshop, the public interest pawnshop, and so on. The third chapter of the Republic of China Shanghai pawn rights and obligations norms, the Republic of Shanghai pawn legal norms are divided into rights norms and obligations norms, respectively explain the pawnshop, the rights and obligations of the store. Chapter four: the enlightenment of pawnshop law in the Republic of China, firstly reviewing the current situation of pawn legislation in contemporary China, and then putting forward the legal thinking on pawn.
