【摘要】： 本文定位于中國(guó)社會(huì)轉(zhuǎn)型時(shí)期的理論視閾,探討民間治理的現(xiàn)實(shí)動(dòng)因和理論訴求,通過(guò)界定民間治理及其主體民間社會(huì)組織的內(nèi)涵和特征,分析中國(guó)社會(huì)轉(zhuǎn)型時(shí)期民間治理的發(fā)展現(xiàn)狀、現(xiàn)存問(wèn)題,國(guó)外民間治理的經(jīng)驗(yàn)與啟示,以及民間治理的法治追求和發(fā)展趨勢(shì)。依據(jù)中國(guó)法治進(jìn)程運(yùn)行的立法、行政、司法、公民意識(shí)和法律監(jiān)督等環(huán)節(jié)的邏輯脈絡(luò),論證民間治理的憲政功能、社會(huì)功能和法治功能,以及在法治與“自生自發(fā)秩序”關(guān)系中的反思支撐作用和中介紐帶作用。運(yùn)用事實(shí)分析與價(jià)值分析、比較類(lèi)比分析、系統(tǒng)分析、歷史分析等方法,得出民間治理在社會(huì)轉(zhuǎn)型時(shí)期為中國(guó)法治進(jìn)程提供結(jié)構(gòu)性支撐和重要推動(dòng)力的結(jié)論。
[Abstract]:This paper focuses on the theoretical perspective in the period of social transformation in China, probes into the realistic causes and theoretical demands of civil governance, and defines the connotation and characteristics of civil governance and its subject civil society organizations. This paper analyzes the current situation of the development of civil governance in the period of social transformation in China, the existing problems, the experience and enlightenment of foreign folk governance, and the pursuit of the rule of law and the development trend of civil governance. According to the logic thread of legislation, administration, judicature, citizen consciousness and legal supervision in the process of rule of law in China, this paper demonstrates the constitutional function, social function and rule by law function of civil governance. And in the relationship between the rule of law and spontaneous order, the role of reflection support and intermediary link. By using the methods of fact analysis and value analysis, comparative analogy analysis, systematic analysis and historical analysis, the conclusion is drawn that civil governance provides structural support and important impetus for the process of rule of law in China during the period of social transformation.
