【摘要】：本文以時間為線索,系統(tǒng)敘述與評論了在中國共產(chǎn)黨的領導下我國法治的發(fā)展,探討中國法治的發(fā)展與中共的關系。在建國之初的法治初創(chuàng)時期,黨領導制定了第一部社會主義憲法,以根本法的形式規(guī)定了國家的根本性質(zhì),是新中國法治的里程碑。在黨政關系方面,加強了黨對政府工作的領導,形成了一元化的領導體制,傳統(tǒng)的執(zhí)政方式得以開始。在這樣的條件下,新中國的司法體制開始確定并且進行了新中國的司法改革。 在文化大革命特殊的歷史階段,黨政關系發(fā)生了嚴重的變異,黨政不分的一元化體制發(fā)揮到了極端,造成了國家政治生活的混亂。隨之而來的立法與司法也遭到了挫折,立法停滯不前,司法機關也遭到了破壞,法治在這個時期有了嚴重倒退。直到文革結束之后,黨對法治建設進行了反思,黨政關系開始了新的探索與改革,逐步開始了黨政分開。立法方面,立法工作在黨的領導下全面恢復和發(fā)展,初步形成了立法體系。在司法的層次上,司法工作也恢復與發(fā)展,并開始了三個階段的司法改革,司法獨立也開始了探索,這對我國法治影響甚大,使得法治重建與發(fā)展。 基于這樣的歷史資料和脈絡,本文分析了在中共的影響下法治的重要環(huán)節(jié)立法、行政與司法在各個歷史時期的發(fā)展概況,了解法治發(fā)展的動態(tài)方向。在本文的最后,通過分析中共和法治的關系,總結了歷史的啟示,然后對中共與我國的法治發(fā)展進行了評價,也對在法治的發(fā)展過程中如何處理執(zhí)政黨與立法、行政與司法三者之間的關系進行了膚淺的探討。
[Abstract]:Based on the clue of time, this paper systematically narrates and comments on the development of the rule of law in China under the leadership of the Communist Party of China, and probes into the relationship between the development of the rule of law in China and the Communist Party of China. In the initial period of the rule of law at the beginning of the founding of the people's Republic of China, the leadership of the Party formulated the first socialist constitution, which stipulated the fundamental nature of the country in the form of a basic law, which was a milestone in the rule of law in New China. In the aspect of the relationship between the Party and the government, the leadership of the Party over the government work has been strengthened, and a unified leadership system has been formed, and the traditional way of governing has begun. Under such conditions, the judicial system of the people's Republic of China began to establish and carry out the judicial reform of the people's Republic of China. In the special historical stage of the Cultural Revolution, the relationship between the Party and the government has undergone serious changes, and the unified system of the party and government has been brought into play to the extreme, resulting in the chaos of the political life of the country. The following legislative and judicial setbacks, legislative stagnation, the judiciary has also been destroyed, the rule of law in this period has serious retrogression. Until the end of the Cultural Revolution, the Party reflected on the construction of the rule of law, the relationship between the party and government began a new exploration and reform, gradually began to separate the party and government. Legislation, under the leadership of the Party, the overall recovery and development, initially formed a legislative system. At the judicial level, the judicial work also recovers and develops, and begins the judicial reform of three stages, the judicial independence also began to explore, this to our country rule of law influence very big, causes the rule of law reconstruction and the development. Based on such historical data and context, this paper analyzes the important link of legislation, administration and judicature in each historical period under the influence of the Communist Party of China, and understands the dynamic direction of the development of the rule of law. At the end of this paper, by analyzing the relationship between the Communist Party of China and the rule of law, the author summarizes the historical enlightenment, then evaluates the development of the rule of law between the Communist Party of China and China, and discusses how to deal with the ruling party and the legislation in the process of the development of the rule of law. The relationship between administration and judicature is discussed superficial.
