【摘要】：西方法學發(fā)展中始終存在"二元"的悖論,未能真正揭示法律的本質內涵。馬克思主義創(chuàng)立了科學的世界觀和方法論,提供了一個科學、辯證、發(fā)展著的法律概念。堅持以馬克思主義理論為指導和總結中國特色社會主義法治實踐,可以得出中國特色社會主義的科學的法律概念——法是"理"與"力"的結合。這個概念體現(xiàn)了法是實質性與形式性的統(tǒng)一體:"理"體現(xiàn)為法律必須承認事實和客觀規(guī)律的作用,必須體現(xiàn)統(tǒng)治階級的意志、人的價值追求(正義等)和愿望,必須吸收歷史上有效的法律制度、技術和智慧;"力"體現(xiàn)為法與國家權力存在內在聯(lián)系。
[Abstract]:There is always a paradox of duality in the development of western jurisprudence, which fails to reveal the essence of law. Marxism created a scientific world outlook and methodology, and provided a scientific, dialectical and developed legal concept. It can be concluded that the scientific legal concept of socialism with Chinese characteristics is the combination of "principle" and "force" by adhering to Marxist theory and summing up the practice of rule by law of socialism with Chinese characteristics. This concept embodies that law is a unity of substance and formality: "reason" embodies that law must acknowledge the role of facts and objective laws, must embody the will of the ruling class, the pursuit of human value (justice, etc.) and the desire, etc. It is necessary to absorb the effective legal system, technology and wisdom in history, and the "force" is embodied in the inherent connection between law and state power.
