【摘要】：通過對基礎(chǔ)條約的擴大解釋以及在修改條約時增設授權(quán)條款等方式,歐盟逐步取代其成員國成為對外發(fā)起制裁的主體,制裁作為一項消極措施目前已成為歐盟外交不可或缺的政策工具。鑒于條約對歐盟的明確授權(quán),歐盟成員國已無權(quán)在聯(lián)盟框架以外分散實施制裁,除非在聯(lián)盟層面無法達成政治共識。在制裁制度轉(zhuǎn)向"聰明制裁"之后,《里斯本條約》關(guān)于司法審查的新規(guī)定加強了對受制裁影響的個人基本權(quán)利的保護。同時,歐洲法院在Kadi案判決中亦強調(diào),歐盟的制裁行動包括執(zhí)行安理會決議的制裁都必須遵守保護基本人權(quán)等以歐盟價值觀為基礎(chǔ)的歐盟一般法律原則,這表明歐盟的對外制裁不僅需要體現(xiàn)歐盟身份和歐盟立場,而且還必須彰顯歐盟的基本價值觀。
[Abstract]:Through an expanded interpretation of the underlying treaty and the addition of enabling clauses when amending the treaty, the European Union has gradually replaced its member States as the subject of external sanctions. Sanctions, as a negative measure, have become an indispensable policy tool in EU diplomacy. Given the treaty's clear mandate to the EU, EU member states no longer have the right to impose sanctions outside the union framework, unless there is no political consensus at the union level. After the sanctions regime shifted to "smart sanctions", the Lisbon Treaty's new provisions on judicial review strengthened the protection of the fundamental rights of individuals affected by sanctions. At the same time, the European Court of Justice, in its judgment in the Kadi case, also stressed that EU sanctions, including sanctions in implementing Security Council resolutions, must abide by EU general legal principles, such as the protection of fundamental human rights, which are based on EU values. This suggests that EU sanctions need to reflect not only EU identity and EU positions, but also EU fundamental values.
