【摘要】： 近代開篇,列強(qiáng)入侵,清政府被迫通商開埠,促使華洋雜居格局形成。道契作為外商在租界的土地產(chǎn)權(quán)憑證,其契式文本與傳統(tǒng)土地契約存在相似之處,但其嚴(yán)格的申請(qǐng)程序以及契證管理,卻較多吸收了西方的體制和經(jīng)驗(yàn),蘊(yùn)含著西方法律制度的精神和原則。 本文以產(chǎn)權(quán)理論為視角考察上海道契制度,文章上篇以上海開埠為起點(diǎn),首先考察了道契產(chǎn)生的歷史背景及演變歷程,并分析了道契對(duì)近代上海經(jīng)濟(jì)的促進(jìn)作用。其次,本文在對(duì)道契產(chǎn)生淵源以及道契性質(zhì)相關(guān)觀點(diǎn)詳細(xì)梳理的基礎(chǔ)上,以所有權(quán)權(quán)能視角探析道契的性質(zhì),試圖通過對(duì)中國傳統(tǒng)土地產(chǎn)權(quán)的實(shí)態(tài)運(yùn)作模式的深層解析,揭示道契制度對(duì)土地所有權(quán)權(quán)能的縱向解構(gòu)。在此制度下,土地所有權(quán)與經(jīng)營權(quán)的分離以及由此確立的以“用益”為中心的權(quán)能體系,促進(jìn)了土地的流轉(zhuǎn)與租界地價(jià)的增長。 文章下篇通過對(duì)道契檔案的詳細(xì)考證和研究,從微觀角度考察道契制度。本文選取英冊(cè)第5197號(hào)道契檔案進(jìn)行深入剖析,并與其它史料相互印證,通過實(shí)證研究與比較分析的方法,結(jié)合經(jīng)濟(jì)史、法制史、契約史,從靜態(tài)和動(dòng)態(tài)角度探討上海道契制度。文章通過對(duì)道契檔案中租地糾紛案件的分析,將道契與中國傳統(tǒng)土地契約及西方土地管理制度進(jìn)行比較分析,在對(duì)契約格式、流轉(zhuǎn)程序以及糾紛解決方式等基本問題分析中,揭示道契制度對(duì)地權(quán)形態(tài)的簡化,并力圖探討其背后所蘊(yùn)涵的契約意識(shí)、產(chǎn)權(quán)觀念、權(quán)力制衡等深層理論。 文章余論探討了道契制度的灰色區(qū)域一掛號(hào)道契,其產(chǎn)生及運(yùn)行是道契所蘊(yùn)含的政治溢價(jià)以及經(jīng)濟(jì)效益的集中體現(xiàn),也反映了中西法律文化的沖撞和融合。最后是對(duì)法治全球化與本土化的反思,道契制度為研究近代法制變遷提供了不同路徑。
[Abstract]:At the beginning of modern times, the invasion of foreign powers forced the Qing government to open ports, prompting the pattern of mixed residence in the Chinese Ocean. As a certificate of land property right for foreign businessmen in the concession area, the title deed has some similarities with the traditional land contract, but its strict application procedure and certificate management have absorbed the western system and experience. It contains the spirit and principle of western legal system. From the perspective of property right theory, this paper examines the system of Taoqi in Shanghai from the perspective of property right theory. In the first part of this paper, the author studies the historical background and evolution process of the emergence of Dao Qi, and analyzes its promoting effect on the economy of modern Shanghai. Secondly, based on the detailed analysis of the origin of the Dao deed and the related viewpoints of the nature of the road deed, this paper tries to analyze the real operation mode of the traditional land property right through the deep analysis of the real operation mode of the Chinese traditional land property right from the perspective of ownership power. It reveals the vertical deconstruction of the right of land ownership. Under this system, the separation of land ownership and management right and the establishment of the power system centered on "use interest" have promoted the land circulation and the increase of concession land price. The second part of the article examines the Taoqi system from the micro point of view through the detailed textual research and research on the Daoqi archives. This article selects the British book no. 5197 to carry on the thorough analysis, and verifies with other historical data mutually, through the demonstration research and the comparative analysis method, unifies the economic history, the legal system history, the contract history, from the static state and the dynamic angle discusses the Shanghai road deed system. Based on the analysis of the land lease disputes in the land lease files, this paper compares the land lease cases with the traditional land contracts in China and the western land management systems, and analyzes the basic issues such as contract format, circulation procedures and dispute resolution methods. This paper reveals the simplification of land ownership form by Taoist deed system, and tries to probe into the deep theories of contract consciousness, property right concept, power balance and so on. At the end of this paper, the author discusses the grey region of the Dao Qi system, the emergence and operation of which is the concentrated embodiment of the political premium and economic benefits contained in the Dao Qi system, and also reflects the collision and fusion of the legal culture between China and the West. Finally, it reflects on the globalization and localization of the rule of law.
