【摘要】：縱觀中國(guó)的近代歷史,法學(xué)界、政治界、外交界受外界環(huán)境影響巨大,在動(dòng)蕩的年代里各領(lǐng)域也發(fā)生深刻變化。出生于這個(gè)時(shí)期的王寵惠以其深厚的法學(xué)功底、精湛的政治學(xué)識(shí)、成熟的外交謀略享譽(yù)國(guó)內(nèi)外他曾經(jīng)多年留學(xué)海外,成績(jī)優(yōu)異,將中外法律思想融會(huì)貫通。擅長(zhǎng)憲法學(xué)、比較法學(xué)和國(guó)際法學(xué)。他還熱衷于政治和外交,是自由主義思潮的領(lǐng)軍者,建立“好人政府”,又在國(guó)際舞臺(tái)上為中國(guó)的主權(quán)獨(dú)立和自由而奔走相告。他為中國(guó)近代法制的發(fā)展和國(guó)家主權(quán)的獨(dú)立奮斗了一生。本文結(jié)合其他的材料,主要是對(duì)王寵惠的一生的法律思想進(jìn)行了梳理。全文共分為三大部分,第一部分主要是第一章,講述了王寵惠的生活學(xué)習(xí)經(jīng)歷和當(dāng)時(shí)的社會(huì)歷史大背景。第二部分包括第二、三、四、五章,主要闡述了立法司法思想、憲政思想、刑事民事思想及其他法律思想,是全文的重點(diǎn)部分。第三部分是對(duì)全文的總結(jié),講述了王寵惠法律思想的歷史影響、局限性以及對(duì)現(xiàn)代法制的影響。
[Abstract]:Throughout China's modern history, the legal, political and diplomatic circles are greatly influenced by the external environment, and profound changes have taken place in various fields in the turbulent times. Born in this period, Wang is famous for his deep legal knowledge, consummate political knowledge and mature diplomatic strategy. He has studied overseas for many years and achieved outstanding results, which integrated Chinese and foreign legal thoughts. Good at constitutional law, comparative law and international law. He was also keen on politics and diplomacy, was a leader in liberalism, established a "good government", and campaigned on the international stage for China's sovereignty, independence and freedom. He fought all his life for the development of China's modern legal system and the independence of national sovereignty. Combined with other materials, this paper mainly combs Wang's life legal thought. This paper is divided into three parts. The first part is the first chapter, about Wang's life and learning experience and the social and historical background at that time. The second part includes the second, third, fourth and fifth chapters, mainly elaborated the legislation judicial thought, the constitutional government thought, the criminal civil thought and other legal thought, is the full text key part. The third part is the summary of the full text, narrates the historical influence, the limitation and the influence to the modern legal system of Wang Daohui's legal thought.
