論韓非的法制教育思想及現(xiàn)代啟示

【摘要】:當前,我國正處于經(jīng)濟社會發(fā)展重要戰(zhàn)略機遇期和社會矛盾凸顯期,維護社會和諧穩(wěn)定任重而道遠。作為思想政治工作重要組成部分的法制教育,越來越顯示出其在維護社會穩(wěn)定和諧方面的重要作用;仡欉^去,經(jīng)過連續(xù)五個“五年普法”工作,我國法制教育所取得的成績是有目共睹的,但同時也還存在著一些問題及不足。我們在借鑒國外先進理念的同時,也有必要對本國的優(yōu)秀傳統(tǒng)文化進行研究,并提煉出其中的精華,進而能夠指導我們的法制教育實踐。韓非是我國先秦法家的集大成者,他的法制教育思想中有很多值得我們借鑒的東西。本文力圖通過對其法制教育思想的研究,以此來豐富當今我國法制教育理論,并運用于實踐。 首先,本文在馬列主義、毛澤東思想、鄧小平理論、“三個代表”和科學發(fā)展觀等重要思想的指引下,從課題的理論意義和應用意義出發(fā)對韓非法制教育思想研究的重要性做了簡明分析。 其次,在對《韓非子》原著的閱讀及參考大量相關(guān)文獻的基礎(chǔ)上,分析了韓非法制教育思想產(chǎn)生的時代背景-—“內(nèi)憂外患、禮崩樂壞”,理論基礎(chǔ)-—“趨利避害”的人性論;“世異則事異”的歷史進化觀;“法、術(shù)、勢”合一的政治觀;“務法不務德”的教化觀。并以此為后面部分韓非法制教育思想的提煉作鋪墊。 再次,通過前一部分的時代背景及理論基礎(chǔ)的闡釋,接下來本文通過一一對應的形式,提煉出了韓非法制教育思想的具體內(nèi)容:“以法治國”、“凡治天下,必因人情”、“古今異俗,新故異備”、“抱法處勢”、法術(shù)“不可一無”、“峭其法而嚴其刑”。 最后,作為本文重點的現(xiàn)代啟示部分,主要是通過對韓非法制教育思想具體內(nèi)容的分析,再結(jié)合當今我國法制教育現(xiàn)狀,分別從啟迪和警示兩方面進行論述。啟迪部分主要是我國當今法制教育實踐應該從中吸取的精華內(nèi)容,警示部分則是我們應該拋棄的糟粕內(nèi)容。
[Abstract]:At present, our country is in the economic and social development important strategic opportunity period and the social contradiction prominent period, maintains the social harmony and the stability heavy duty but the long way. As an important part of ideological and political work, legal education is playing an important role in maintaining social stability and harmony. Looking back on the past, the achievements of legal education in our country are obvious to all after five consecutive years of popularizing the law, but there are still some problems and shortcomings at the same time. While drawing lessons from foreign advanced ideas, it is also necessary to study the excellent traditional culture of our country and extract the essence of it so as to guide our legal education practice. Han Fei is the epitome of the Legalists in the pre-Qin Dynasty in China. There are a lot of things in his thought of legal education that we should learn from. This paper tries to enrich the theory of legal education in our country and apply it to practice. First of all, under the guidance of Marxism-Leninism, Mao Zedong's thought, Deng Xiaoping's theory, the "three represents" and the scientific development view, This paper makes a brief analysis on the importance of Han Fei's thought of legal education from the point of view of its theoretical and practical significance. Secondly, on the basis of reading the original works of Han Fei Zi and referring to a large number of related documents, this paper analyzes the background of the generation of Han Fei's thought of legal education-"the internal and external troubles, the etiquette and music bad". The theoretical basis is the human nature theory of "seeking advantages and avoiding disadvantages", the historical evolution view of "different things in the world", the political view of "law, skill, power" in one, and the enlightenment view of "service law does not serve morality". And for the latter part of Han Fei's legal education thought as a platform for refining. Thirdly, through the interpretation of the background of the times and the theoretical basis of the former part, this paper abstracts the concrete contents of Han Fei's legal education thought through the form of one-to-one correspondence: "governing the country by law" and "governing the world by human feelings". "ancient and modern customs, new reasons and different preparation", "to deal with the law," magic "must not be without," "kurtosis and severe punishment." Finally, as the key part of the modern enlightenment, mainly through the analysis of the specific content of Han Fei's legal education thought, and combined with the current situation of legal education in our country, it discusses from two aspects of enlightenment and warning. The enlightening part is mainly the quintessence of the legal education practice in our country, and the warning part is the dross content that we should abandon.
