【摘要】：經(jīng)過岳麓秦簡《為獄等狀四種》與張家山漢簡《奏讞書》的比較,發(fā)現(xiàn)《奏讞書》與《狀四種》這兩個案例集有很多相同的法律術語,而且刑罰等級及據(jù)此確定的加刑、減刑原則及訴訟程序基本一致。《奏讞書》中的三類案例也見于岳麓秦簡《狀四種》中:"疑罪"類;"乞鞫"類以及"上得微難獄者"類。可以說,雖然經(jīng)過了朝代更迭,由秦朝所建立的司法機構大體上被漢朝予以采納,在根本上沒有大的改變。
[Abstract]:Through the comparison between Yuelu Qin Bamboo slips, "four forms of prison", and Zhangjiashan's Han Bamboo slips, it is found that there are many common legal terms in the two case collections, and that there are many identical legal terms between the two cases, and that the penalty levels and the penalties determined therefrom are increased. The principle of commutation of sentence and the procedure are basically the same. The three kinds of cases in the Book of conviction are also found in the four kinds of cases in Yuelu Qin slips: "suspicion of crime", "begging" and "those with little difficulty in getting a prison". It can be said that although after the change of dynasties, the judicial institutions established by the Qin Dynasty were generally adopted by the Han Dynasty.
